I am eligible to file 485 on June 1st, but my passport expires on July 1st week. what do you guys think , do I need to get new passport before I apply or USICS do not care about passport expiration date as long as I have valid passport on petition submission date?

Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

Sunny and Rolling came out as selfish to the majority of the members because they just focused on their issues first and identified some of the root causes for their long wait.
I think we should all atleast encourage them in their pursuit for justice. We have nothing to lose. When a specific group works on an issue which is affecting them most they would do the best to get that fixed.
This would motivate other smaller groups with other issues to take up theirs seperately. The more this happens the more heat it will generate on these 3 agencies DOL, USCIS and DOS.
Then we as a bigger organization can work much faster on getting the bigger issues resolved which in turn will fix lots of these smaller things in the system.
These kind of initatives are a win win for everybody. Every small step would help us go move towards our goal instead of trying to take one gaint step and getting bogged down.
PS: Waiting for miracles is onething for people who trust in God

For all the geniuses out here, how many companies like Google or Microsoft or yahoo came out of India in the last 20 years? Yeah, that is what I thought too.. BIG ZERO. But if you read J(erk) Thomas' response, one would have thought that India is full of competitors for Microsoft and Google today :D :D :D
dude, how many immigrants/H1/L1/GC/Gc->US citizens work for google/Msoft/Yahoo. And if you are naming these corporations as the benchmark of success/technical excellence why do you not listen to what they say about visa programs?

Why don't you use direct flights to India. There is Continental from NY & American from Chicago to Delhi everyday. If you directly book from their websites, the prices are quite reasonable. At least American I know also serves Asian Vegetarian (meant for Indian veggies) food.

What stopped (from legal stand point) MBA guy to file for eb3 based GC in 2003? Remember both have BS in Engineering at that time. No employer was ready to file GC for the MBA guy (in 2003) is not a valid legal argument.
Remember, one does not need to be employed to file for GC and GC is for the future job.
It is not what you or I think is fair. From legal point of view, both had equal opportunity to file for GC in 2003 for eb3 job. Just because, the MBA person didn't go for it is not a valid argument. Don't you agree?

With regard to the reform issue in Congress, the expectation as of this week was that the Senate Judiciary Committee could take up the various reform bills as early as Thursday, March 2.
The initial discussion in the committee would focus primarily on the proposal drawn up by its chairman, Sen. Arlen Specter of Pennsylvania.
Specter has presented a so-called "chairman's mark" which is comprised of original proposals and some aspects of other bills including the Senate's McCain/Kennedy bill, and the Sensenbrenner/King bill, which has already been passed by the House of Representatives.
The Judiciary Committee hearing is a prelude to full Senate consideration but St. Patrick's Day is likely to delay that for some days after March 17.
This year, for the first time, Congress is taking a week off after the Irish patron saint's day and officially labeling the break as the St. Patrick's Day recess.
That would mean that the earliest likely date for a Senate debate on whatever the judiciary Committee presents it would begin on Monday, March 27.
Given the sharp contrast in the main bills, that debate could some time, weeks if not months to complete.
Meanwhile, Bush noticeably advanced his position on reform in his State of the Union speech to the joint houses of Congress.
"We hear claims that immigrants are somehow bad for the economy, even though this economy could not function without them," he said.
"All these are forms of economic retreat, and they lead in the same direction toward a stagnant and second-rate economy," the president added.
"Keeping America competitive requires an immigration system that upholds our laws, reflects our values and serves the interests of our economy.
"Our nation needs orderly and secure borders. To meet this goal, we must have stronger immigration enforcement and border protection. And we must have a rational, humane guest worker program that rejects amnesty, allows temporary jobs for people who seek them legally, and reduces smuggling and crime at the border," he added.
However, as with previous statements, Bush did not go into detail as to how he exactly defines amnesty.
How he, and Congress, ultimately defines it will have a profound effect on the lives of tens of thousands of undocumented Irish.

Today got the magic e-mail Card/ Document Production . Looks like the SR submitted 3 days back worked in my case. Prior to my SR the IO said that they don't have FP cleared, I called FBI and confirmed that they sent back my FP's and in my SR I request the IO to input the details that I got from FBI, Looks like that did the trick.

I Have opened an SR on Aug 6th and then sent an email to TSC followup . I got a response from them on friday " We are currently researching this situation and will contact you with an update." HAs anybody this kind of response?

I had created two different SRs, one for myself and kids and one for my wife. The SR which I created for my wife got a response with Card Production Ordered and for the SR I created for myself, the status in the response was "currently under the review". The date was one day before my CPO mail date.
I guess you have nothing to worry. This seems to me as a standard response.

I agree I too have never seen H1B only ad's anywhere even body shoppers never post this kind of ad which is blatant discrimination. I guess the best way to say H1B only is to post ultra low wages (something close to state minimum's) that way only H1B show interest. SO the best way to tackle it is by either raising state minimum wages to make it fair playing field for all or auditing present companies to check for misuse of H1B with folks on bench, non pay, false documentation etc.
I am in the US for 7 years now, and frankly, I am yet to see a H1B ONLY job posting...

If I am not wrong, buffering wud be to take in new 485 applications, process them and keep them ready.
In that context, most of the applications till 07/07 have been preadjudicated, new buffer wud require dates to be pushed to 07/07 or later.
I would think they move to 07/07 first to see any missing demand to appear in the next month or two and then move significantly, if needed, in the final quarter!
