I saw posts of several members extremely skeptical of the whole idea, even went on calling it stupid, crazy and useless. Some made mockery suggesting sending dead fish etc. I don't see any more posts from them.

I will participate in this wholeheartedly. One suggestion to the admin: perhaps we can post this in other websites also like ? I know a lot of people use that site for posting problems etc and whoever is not in IV might also get to know about it.

This is a brilliant thought and lets put it to action now.We all can ask for putting us all Legals on Path to Citizenship. I would definitely put in effort , this may lead to some other solution.

1. If a Receipt Number is issued for a I-485, does it necessarily mean that the case won't outright be rejected for a missing document/ evidence, but instead an RFE will be issued?
2. When a receipt number is issued for a I-485, and if we send out the missing document/initial evidence using the allocated A#, is there a good likelihood that the evidence/document will make it to the appropriate file?
Answers to these will help make a decision on filing multiple I-485's where the first I-485 missed some initial evidence.

One more thing: I was about to make another private consultation call today. I pledge contributing $200 if I find a concrete answer to this issue without having to consult one more lawyer.

Agreed on your point. But there are other discriminations at workplace such as , age, race, sex and sexual harrassment. Those who complain about it effectively terminate their careers. If you want to go , complain against this L1 misuse fine, but you are not going to get mileage, maybe some bad breath and bad publicity and eventual loss of reference & job. If your company / client has decided they do not want to persist with you, there are 101 ways they can get rid of you, legal or illegal, my suggestion is, if you were exposed,
can L1fraud hold his head high in front of his client and still ask for reference with no sense of guilt in future? If not, he has lost half the game but now wants to lose the other half in a self destructive manner.

Of course, person on L1 status can work at client site as long as he/she is directly managed by company that has sponsored L1 visa. They can not be directly managed by client. That is the restriction. Have you even read posts in this thread?

I am July 2 filer and I called yesterday and they gave me this BAD news. They said "Other reasons". I can't think of what they could be. They said they are sending application back which I did not receive yet.
Any one here unlucky as me unfortunately? Anyone have came across this situation? Your help will be greatly appericiated.

Raju Sen Sharma woke up Tuesday with one important errand in mind: He had to order flowers and have them delivered to Washington, D.C.
The 29-year-old man, an Indian immigrant in Orlando, was not marking an anniversary or wooing a sweetheart. The flowers were for Emilio Gonzalez, head of U.S. Citizenship and Immigration Services.
Sen Sharma was sending them as a symbolic reminder of the plight of foreigners like him, who entered the U.S. legally but cannot find a way to remain permanently.
In a recent Indian-made movie, sending flowers to prove a point was the method used by the lead actor, following Mohandas K. Gandhi's teaching of nonviolence.
So hundreds sent roses and daisies to peacefully protest the recent reversal of a decision that would have allowed many to apply for the "green cards" entitling them to permanent residency.
Immigration-agency spokesman Dan Kane said about 200 flower arrangements had arrived at the Washington, D.C., offices by lunchtime Tuesday.
Gonzalez said in a statement that he had those flowers forwarded "to our injured service members" at Walter Reed Army Medical Center and the National Naval Medical Center in Bethesda.
"We have been trying to get the green cards in the legal way, and we have gone through all the process and it hasn't worked for us," said Sen Sharma, an energy-software analyst at the University of Central Florida. "We just want a fair chance."
Other immigrants are joining a class-action lawsuit about the rejection of their petitions, to be filed by the D.C.-based American Immigration Law Foundation and the American Immigration Lawyers Association.
Engineers, programmers, lab technicians and other educated immigrants had scrambled to file paperwork, following a June visa bulletin from the U.S. Department of State that gave them hope visas were still available.
But U.S. Citizenship and Immigration Services issued a terse statement July 2, saying it would reject the status-adjustment applications because it ran out of those visas.
Kane said he could not comment on the mix-up because of the expected lawsuit. The agency has an annual cap of about 140,000 employment-based visas; hundreds of thousands of foreigners compete for them.
"It's very disheartening for people to get their hopes up and spend thousands of dollars in filing paperwork to then be told nothing is going to happen," said Aman Kapoor, president in Tallahassee of Immigration Voice, the group leading the flower campaign.
Catherine Henin-Clark, an Orlando immigration attorney, said the cap leaves thousands of worthy immigrants in the limbo of temporary status.
"When it comes to legal immigration, we are not encouraging the people that we want to have here," Henin-Clark said. "We are turning them away, and that is going to affect the economy one way or another. We have always relied on foreign workers."

The OP could try contacting the manager of the HR regarding the EAD thing before getting lawyered up. Clearly the policy, doubt there is one, violates whats stated on I-9. You are not asking CapitolOne for any sponsoring of GC. What if you are a derivative holding an EAD? Did they know that when they decided to quote this "policy" of theirs? Doubtful.

What part do you want interpreted? It says in plain simple english that it is wating to be assigned to an officer.
You can take an infopass to find out if your case is pre-adjudicated, prints/name check are clear.

You still did not get it. Without evidence of discrimination it would be difficult to fight against... Forget this for a moment, in any law based battle you have to have a evidence. It is not that I do not want to fight or somebody do not want to fight. How could you make the base for fighting? This other guy, with his sheer luck (And with Capital One's stupidity) could get written evidence and so he has a valid base to fight against. And without evidence, whatever you write to whomsoever authirities, it would just be a blabbering. Even as one platform if IV decides to fight against this, IV team (Or lawyers whom we appoint) will ask the evidence first to make the case. Other thing, do not forget, what we could achieve in July 2007, the base was definately a first screw up from USCIS ( That is an evidence...). Once that screw up happened we could right away make it a reference and could make it a battle point.. Do you still understand or you do not want to understand?
I do understand that without evidence you can't fight the conventional way or file a law suit. It would be difficult, if not impossible. I am not debating that. I never said it would be easy. Even with evidence (in case of Capital One), one can argue if thats a good enough base for fighting and whether it will do any good if the case is won. Thats not the point.
What would you do if a recruiter or employer told you (verbal or writing) that it is their policy not to hire Indians? (I am just using India as an example).
Regardless of written evidence, I would be inclined to do something about it. I am not saying that I will file a law suit. I would probably not even want to work for such an employer. But I will not be speculating that oh, there must be some loophole that allows employers to have such a policy; because many of them are saying that, it must be legal. I will not assume that they can do this under "Hire and fire" authority. We just seem to have a little difference in opinion about that. We agree on pretty much everything else. Thats all. And frankly, its good to have an opposing perspective on things.
Now, if I hear from experts that my understanding of the discrimination laws is incorrect and that it is legal for an employer to say that they will not hire somebody with EAD, I'll just shut up. Until then, I will encourage people not to be quiet and to call the hotline, file a complaint, call the media, and pursue whatever means we have at our disposal to fight what we consider injustice and fight what we believe is discrimination as per the law.

We will make next week as a "WEEK OF ACTION". If you see my other thread ("can we send Pizza" thread) and many others, the common routine is to get many good ideas, but not much action.
We will gather as much support as we can till this weekend and at the same time make sure we consolidate the contact information at one place who to contact, and then starting next week, we can start sending out our message as loud as we can.
We must push for 5 years GC and 10 years Citizenship. I know how much painful it canbe for someone after 11 years waiting for GC, wheras others with 6-7 years in US applying for Citizenship. Not that they got it, but why we did not get it.
And we will focus on points how we can contribute in this crisis.

Atlast got receipts by calling USCIS - after 1 days i saw checks cashed , receipts waiting. thanks for all ur help guys keeping looking for and as per USCIS they are bound to clear all the backlog by end of oct
