I have applied for labor certification in Dec 2006. In may 2007 I got a denail stating that the company is not "bonafide". It is a new company and I am the 1st applicant for labor. We sent all the supporting documents and requested for review/appleal in May 2007. Since then we did not get any status from them. My attorney called them last week and made an inquiry. DOL Atlanta said that they need to do the "central check" of teh company. They do this for every new company. Does anybody aware of this "central check". How long it will take?

I have a question regarding an appeal I did a year ago for a rejected LC.
I have an approved LC and I-140 on an entry level position (EB3) with my company. after I got a promotion to a senior position that requires a masters degree but with a smilar job description but more senior and supervisory responsabilities with the same company. after promotion, I filed for a new LC (EB2) but it got rejected because DOL thinks it is the same position as the already approved LC. my company and I wrote a letter as an appeal on Sep 2006 within 30 days from rejection of LC to BALCA explaining that new position requires a masters degree and it is a senior position with more supervisory duties. as of today, almost a year later, we haven't heard anything regarding DOL (BALCA) decision on my appeal. is anybody in the same situation?? what should I do next?? also I read somewhere that DOl might revoke the already approved LC EB3 after I filed a second LC for EB2 with the same employer. can DOL revoke the first LC EB3 after I have an approved I-140?? please help. He/she might have thought why would there be more GC approvals than LC approvals...might have forgotten that there were 50,000 Schedule A visas at that time...Sked A is labor-exempt.

Have you got this info from a truely realiable source? It seems there are 2 different opinions about this process, that's why I'm asking. I think it's fair to go by PD, but how CIS could sort out earlier PD from tens of thousands of applications is another question.

Congratulations on clearing your first hurdle. I talked to my attorney today and she said that audit reply was on March 11th, and need to wait 4 months before we can contact the DOL about the follow-up. Need to wait 2 more months.

People like me are sitting on the fence. I wouldn't regret even if I don't get a GC at all...Sometimes, I feel that I am just waiting for any chance to go back to India... It is just the consideration of continuity in life for the family that really is driving me every day... It doesn't mean I will feel bad if I get the GC. The wait is simply not worth it. been living in multiple countries for the past 13 years... US is one another country for me.... That is just my case. I visit the forum and post in here because I can just monitor the situation... It is like monitoring my stocks, news on Libya,World cup, etc. Don't get me wrong guys... I wanted to share my facts.

This request is regarding workers on H-1B:
Problem: H-1B status ends the moment a foreigner worker looses his/her job, and s/he is effectively out of status. The foreign worker has only 10 days to wrap up his/her affairs and leave the US. 10 days is just not enough time to wrap up five or six years of living and move.
Solution: The foreign worker's status must automatically be extended by 90 days in the event of job loss.This gives the worker enough time to get his/her affairs in order -finances, car, house/apt, kids in school, etc.
