    The OP could try contacting the manager of the HR regarding the EAD thing before getting lawyered up. Clearly the policy, doubt there is one, violates whats stated on I-9. You are not asking CapitolOne for any sponsoring of GC. What if you are a derivative holding an EAD? Did they know that when they decided to quote this "policy" of theirs? Doubtful.

    Thanks guys .... for coming behind me .. Shane Warne or Purple Haze won't satisfy you guys .. Y dont we discuss how Kanimozhi's discontent couldn't play spoil sport for the new govt and how Azhagiri got cornered with chemicals and fertilizers (these 2 are not any interntaional fame for an american 'tunnel rat' to know abt them).

    Above all I am here to get some information to bring a company which violates rules to authorities, nothing more nothing less and not here to do any name calling of mud slinging.

    1. Lack of description and detail about what it is ?
    2. No time stamp on the report
    3. Provide some commentary and detail about the parameters used in the report.

    My EAD expires today, I applied for the renewal on April 6th. This is my 4th EAD and I totally missed to apply in time this time.

    1)Is there any way to speed up the process to get the EAD soon?
    2) I cannot work from next week is there any way I can get through this ?

    Tough problem indeed. Especially now that they are not entirely following their rule to give you a 90 day response. Instead they now suggest you apply 6 months ahead! For a document valid less than a year and for which the filing price is expected to double soon. They are basically asking you to apply every 6 months or so. I wonder why they do not charge 4 times and give it for 2 yrs, atleast we can avoid the stress.

    Anyway, one consolation is that my lawyer says they have been approving it with an effective date the day after your last expiry, but thats not a guarantee. The situation sucks. I applied 95 days ahead(my 3rd EAD application by the way) and am still a little antsy with a month to go. Of course you remain in status due to pending 485 but whether to go to work is a different matter. I personally am planning to take a few days off at that time should it come to that.

    I think if you have I-551 stamped on your passport then you do not need any other document. i-551 is as good as physical green-card. You can carry the approval notice with you. This is my opinion, do no quote on me.

    This is what i am doing to call a cell phone or any land line in india. Vonage has a call forwarding feature. Simply log in to your vonage account and go to features and configure the call forwarding feature.Configure such that the call is forwarded after 20 sec's. Intially vonage rings and after that it is forwarded to the india cell or landline forwarding number. Its free of charge as calling from vonage to india #'s is free. Hope this puts the debate to rest.

    I already took Vonage world phone. I am happy with it. However, I happened to see somewhere in the thread about Lingo offering india calling even through the mobile. That had me give a second thought on switching over to Lingo.

    However, when I read the fine print on the lingo site, it mentions you cannot call Mobile phones in India. This catch makes me go crazy. Can some one confirm how are they handling with this constraint. Is that still a good option to switch over vonage to lingo based on this single feature?

    Thoughts are welcome...

    Today I got I-140 approval and I am eligible for apply for I-485.
    Case successfully transfer from EB3 to EB2
    I am also anticipating international travel on business.
    My lawyer told, just applies for I-485. As I have H1 approval till 2009 and current visa sampled on my passport.
    I am thinking to apply for I-485, EAD and AP at the same time.
    Is it good to apply I-485, EAD and AP all at the same time?

    I was told, once I-485 applied I can�t travel unit received the notice of receipt of I-485. Is this true?

    I have filed my green card with her. But in all our discussions she has sided with my company's interest over mine. In fact in one of our FYI meetings, she said that getting the green card faster would not be good for companies as people would quit after that. So I am not sure whether she will take up the cause but we can try.

    Landed in this country on Aug-16-1997 for Masters. Today myself and my wife both got CPO mail/text message. Thanks IV community and good luck to all. I will be doing my part to make this system better!!!

    RD: 07 Jul 2007, TSC (I-140 was with NSC, but the attorney sent it to TSC in the july 2007 fiasco)
    ND: 27 Aug 2007, NSC

    Didn't do anything in 2008 and decided to do everything possible this time around.
    Aug 3 - Primary I-485 SR,
    Aug 5- Primary EAD SR,
    Contacted Congress Woman on Aug 9 - Didn't get any useful info. I think, being in bay area, they might have been flooded with these requests.
    Aug 10 - Opened an Infopass for Aug 18
    Aug 16, 8:30 am - Dependent SR
    Aug 16, 9:30 am - Called the customer service for primary's status - got the standard response that they sent a mail (which i didn't get) asking me to wait for 60 days.
    Aug 16, 10:15 am - Wife called me to inform the good news, the online status change.
    Aug 16, 10:18 am - got the text message (which just said "check your status online").
    Aug 16: Got the CPO mail (time stamped 10:18am)

    Guys (and Gals), Hang in there and you will have your independence soon.

    I don't get how you are getting the 8008 figure. Based on the 9%, you are right about the cap for any country being 12,600 for all EB categories combined.
    Pre-adjudication has nothing to do with country quota. And 'assigning a number' is still based on country quota. With all the pre-adjudication, it is likely that 'assigned numbers' = GC approvals. The 'assigned numbers' concept was a lot more relevant till last year, when they had numbers, but still had to 'process' the applications. Now most applications seem to have been 'pre-processed'(pre-adjudicated)

    I do appreciate your work. Just trying to help achieve a more accurate figure.

    1) Each (EB1/2/3) - 28.6% WW quota = 40040
    2) 5 subscription cataegories under each EB category: I,P,C,M,ROW
    3) Assumption - USCIS distributes equal share among these 5 different subscription categories = 40040/5 =8008 in each EB category for a particular subscription category.

    Example:

    EB3 All = 40040 ( 0.286 x 140000)
    EB3 ALL = EB3 I + EB3 C + EB3 M + EB3 P + EB3 ROW

    Assuming equal share of all of these 5 subscription categories - 40040/5 = 8008 applications to be worked for "Assigning the visa number" not " for granting the visa (IN other words physical greencard order)"

    7% + 2% = 9% country specific limit is meant for "Granting the visa - Ordering Physical Green card" out of "Applications which have been assigned a visa number" NOT FOR "Assigning the visa number"

    I doubt that. Medical was relaxed since it can take time for people to get the medicals done. Also immigration doctors were all busy at this time. So it is possible that people arent able to get the meds done by the Aug 17 deadline. The other documents like EVL shouldnt take this long. If the employer is willing to provide future employment to someone then it should be sent along with the application. Whether USCIS will relax for lack of Initial Evidence other than Medical is hard to say. It is always better to be safe than sorry.
    But I agree, these two things are different. Only medicals have been relaxed by USCIS via its press release. Since a lot of the lawyers have sent without some initial evidence, AILA should use its proven;-) negotiation skills to get USCIS to issue a new press release which ascertains that only singatures and filing fees are required at this time.

    Remember: NumbersUSA faxed the senate offices one million times when CIR was being considered. We have to do more than them this time, as they are twisting the facts (Same way Mr. Dobbs of CNN does): Here is a quote from Numbers USA website:
    ....The bill�s sponsor, Immigration Subcommittee Chairman Zoe Lofgren (D-Calif), claims it would �recapture unused employer-sponsored visas� from as far back as 1991 and then add them to the current numerical cap of 140,000 employer-sponsored visas that are available each year. That means that there are no �unused� visas from past years to �recapture.�


    The last line above is a blatant lie. Specially when USCIS ombudsman who has access to all the internal material of USCIS says otherwise. Please call, and let the congressmen and congresswomen know about this.
