    There is a difference between laws and regulations. Laws are what in INA (Immigration and Naturalization Act) and Regulations are what in CFR.
    It takes congress and senate to change laws where as it takes discretion to change regulations. And the good news is that discretion can be challenged.
    There is another thread on the issue and some of us think that we do have a case. Initial response from a certain lawyer has been positive.

    The affected parties (i.e. us) need to show damage in certain way and I do have some points that can be used. Our primary point is that the spirit of law has not been upheld.

    Following are the steps in making this a reality:
    a) Gather around 50 people
    b) Develop and finalize draft of the case. Rolling_Flood has a initial draft.
    c) Hold initial consultation with a lawyer.
    d) Decide as a team if we want to continue.
    e) File a class action suit or next course of action
    (as of 08-29-08 , we have dropped the idea of lawsuit and are pursuing other avenues)
    Not sure what is the total cost but given the years of wait and uncertainty $500 per person should be reasonable. I will also create a yahoo group to start these discussions.

    Notes:
    If you already have applied in EB2 you won't be affected.
    If you have a Masters you won't be affected.

    These people might be able to help, provided
    a) You have EAD
    b) The employer refused you a job based on the fact that you have EAD.
    Needless to say if they reject your for the position based on anything else, all bets are off. So I guess one needs to be able to prove that they were refusing you because of your EAD. I am not a lawyer, so please take all this with a grain of salt.

    Unless the baby cries and asks for food, mother does not feed the baby. Similarly congress will provide relief only if we ask for it.

    Can somebody please send me the addresses for sending regular mail. I have 30 posters almost ready,. I am checking. I have those 6-7 addresses (Zoe, Director, John, department, etc) but I need many more.

    I have send emails to my credit card company and the people who processed the payment and none of them have been able to help me.

    You should just fill a dispute form and send it to your credit card issuer. It's probably not too late. The bank can and should refund you the overpay.

    I came here on F1 and i was on F1 when we applied for 485.
    after i got my masters i did not apply for opt and used the EAD card i got through 485 for working.
    I changed my status from F1 to H4 once i graduated.I never traveled after i came here.

    Will i face any problems in future when our pd becomes current.
    Our lawyer says there should not be any problem but i don't know if he is correct.:(

    I agree with 485Mbe4001 and many other folks on this thread that have talked about the results of Obama victory - USA would face socialist policies and personally our GCs could be affected by protectionist agenda. I have never understood why Indians (even 2nd generation) by default support Democrats, when all the values and rational reasons point us towards Republicans. I am libertarian in my views and a staunch supporter of republicans.

    Reasons for Immigrants to support Democrats -

    1. Generally religion neutral and not influenced by christian right wing
    2. Generally tolerant of people from other cultures rather than being a party of white folks run by white men
    3. Tendency to help human/environment suffering
    4. Afraid of military draft that could recruit our kids


    Immigration

    Now coming to the issue on hand, overall roughly 60% to 80% of americans do not want any kind of immigration (check wikipedia). That is the unfortunate truth! We should all be lucky to be here due to generally business friendly laws that allows for H1B visas and EB GCs for skilled labor. If left to public, immigration would be banned. Hence, I believe both parties use this as a posturing issue during elections to their favor. khodalmd in the previous thread explained the breakdown of republicans/democrats accurately. Logically speaking, republicans can be convinced about its need to sustain economy and generate taxes as more baby boomers retire, but this logic is these days trumped by mix up with illegals.

    If Obama wins, economy/stock market would tank, more jobs would be outsourced. My fear is that during those times, any kind of immigration law would not pass. If god forbid, layoffs start to roll, then many of us may have to start from scratch, hence I call it perfect storm.

    Hi All,
    I got the I-485 approval/welcome notice from USCIS for myself and my spouse today. But the wierd thing is that my NSC online status still shows RFE response received and case pending (from 2008)...the welcome notice says I should expect to receive the card in 3 weeks...guess I am greened.
    Anyone else face a similar situation?

    It is not that simple. The soundex algorithm will change the spelling of each name (F, M, L) and do multiple combinations during the name check process. So a Sita can be become Seeta or Satyendra may become Satinder and so on. So don't count your chickens as yet:)
    well this is great news there were no hits for my husbands name and only 1 hit for my name! Hopefully we will be ok and not get stuck in name checks then! Thank you for your response!

    Its good to hear from ppl that they got an Yellow form from Infopass etc... I have been to San Jose USCIS office multiple times asking for status.... I just don't receive any concrete information from them...Infact, they are even hesitant to create an SR to request an update...

    Any one else visited San Jose USCIS office? Similar experience, please share it with us...

    and What do u mean by stating that 485 is at local USCIS office? All 485 applications will b at either NSC or TSC, rite?

    I had an SR open for which i got the response as wait for 60-90 days and case is in the process of review.

    I went to Infopass (San Jose) twice and both times they said, i need to wait as your case just needs to get picked up for processing and every thing else looks ok...

    Called the NCSC and they also tell me to wait for 30-60 days....


    What other things can we do to actually get our case picked up?

    My case was at local office for interview and transferred from TSC. If your case is at TSC..Please dont waste time by taking infopass. Only way for you to raise SR is to call i-800 number and request them to create SR. Infopass officers usually does not creates SRs.

    Today I called USCIS and finally got my wife's and mine I-485 receipt numbers. My attorney has not received anything. I am looking forward to seeing some action for others pretty soon. Guys, I wish you very best luck!!

    It's tough to tell. According to processing times on usics.gov, I-90 takes 3.5 months in Nebraska service center. But the form is supposed to be mailed to Phoenix and I could not find any times for the Phoenix office. Since it's a simple correction, I'm hoping a 2-3 week turnaround time but be prepared for a 3+ month wait. If you need to travel, it's better to get an I-551 stamp in your passport so you can travel regardless.
    Thanks Rams75 so I guess I need to get an INFOPASS to get the I-155 stamp on passport?

    OK,

    July 2nd filer and hear nothing.

    Faxed congressman�s office yesterday (Tuesday) morning. The immigration staff called back right for more information. She said she would make an inquiry through her channel.

    She called me just now (Wednesday morning): my application is lost � meaning USCIS can�t locate me in their system. This is not new. She probably just called the USCIS customer service line but they can�t say crap like call back after 90 to 120 days. The staff was told that USCIS asked to give them a week to do some inquiry into their system and she will call me back next Wednesday.

    On Monday, my attorney has sent an inquiry to the local Senator�s office on the 4 pending cases he has filed. Not heard anything back yet.

    Given all the crap I have heard from USCIS customer service, I have NOT made a single call. That would have not made any difference on the fact I am not on the system anyway.

    Will post back if there is development.
