    what about having a PD of May and getting approval bet 1 and 16 aug??? i'm stuck in atlanta PERM center....

    I was supposed to travel on 31 july to india and am considering changing my tkt to 17 aug or so....just in case...that's stupid huh?????

    eligible to file 485 before AUG 17th is your case must certify by July 31st period. eligibility is LC approval not on LC filing. if filing is considered ,in that case people who are stuck in BEC can also file before u.

    While this is an important issue, it could be largely addressed if backlogs are eliminated, thus speeding up the adjudication time. At this time there is no specific charter to address this issue, however, this is a problem that persists across the spectrum, and not only in employment-based immigration categories.

    (I will bring this to the notice of the Core Group, however, one should take note that we cannot have a very broad agenda, as it would be challenging for us to approach Congress with requests).

    I talked with my lawyer yesterday, was informed that American immigration lawyers association (AILA) is filing for a class action lawsuit against DOL. There has been about 40% cases that are getting audited in Atlanta center. But after replying to queries, the center is not responding on a timely basis. There is light at the end of the tunnel.:)

    Like I said you can start at the same pace as you normally walk from your car to your office. Do that for 20 mins or 30 minutes this week and we will increase the pace very slowly and add a few minutes each day. Also always listen to your body and do what your body can. it is very important to respect our body's limitations. I have learnt that the hard way

    Yeah I started off faster than normal and for the last five minutes I did a stroll.. Its gone now, I don't feel it anymore.

    Hunger strike ?, i dont know my friend, sounds like a neat idea to get attention, but then what happens if its becomes an indefinite hunger strike, i mean i hope you do understand the consequences of that.
    I think we are at a stage where people are fed up with the process, but i hope good things happen to people who wait.

    Waiting is all we have been doing for so many years. I have been living separately from my wife for last 3 years. When I reached out to Pappu on IV, he refused to do anything for me. I am ready to come forward and talk to media but nobody is here to listen.

    I am seriously considering some media awakening event these days, it might be suicide or whatever it takes but this DOS stupidity has to stop. Its affecting so many people's life. I agree GC is not a right that we can demand from US government but they can't treat us like this after investing so many productive years for this Economy.

    I have booked my tickets. I will fly in to DC by Saturday noon and fly out Monday evening. I got greened last year and I owe a lot to team IV and its members. I used to be very active on IV and always a good friend to Pappu, Aman, Jay and all other IV members.
    I have done lawmaker meetings twice in the past and would like to share my experiences with you all and also help with talking points etc... based on experience.

    I appeal all IV members to take advocacy seriously. Changes come only through persistent efforts and thats exactly what IV is doing. Most IV core team members already have green cards or are citizens and they don't need to do all this, but they are doing it because they believe that persistent, sincere, honest efforts would definitely reap benefits.

    Please contact your friends, relatives and co workers. Conduct local meetings, explain to them about IV and what it is doing. As IV members are well informed and understand the situation - especially EB3 folks, ignoring such events and not doing anything active is not an option.

    Why is the advocacy day so important? This is politics 101. One can be a great doctor, great engineer, great scientist and anything, but at the end of the day, we need to understand the dynamics of things and how things happens and do things accordingly. We are all great achievers primarily - we went to good schools, worked hard, got good jobs, able to migrate to the US and have excellent leadership qualities, we have good friends, nice families, great kids and cannot complain about life in general. But getting delayed on GC is very frustrating and if we do not understand what this is all about and what it takes to find a solution, then we are just missing that essential thing in life which is "what we would need to do to change things that helps us all". Reducing GC backlog and streamlining process is a win win situation to all and such message needs to be conveyed in an appropriate way. It is our issue and we need to take it up and not expect things will fall in place automatically.

    These days I see so many campaigns on facebook, twitter, etc... and the world is not like before. Public voice and opinions are being taken very seriously and if we do not live up to the times, then we basically lose big time.

    Do we want to lose it? I am sure we want to win.
    Can we all unite and help ourselves? I am sure we will.
    Can we all come forward? I am sure we will.

    Folks - we are all creative in different ways. Lets do what we can to further our cause. I wish a lot of people change their minds after reading my message.

    I will keep posting inspiring messages when I get a chance.

    Thank you. The community needs to wake up. Times are going to be tough not just for H1B but for everyone else in line for GC.
    Advocacy is a long term process that requires lot of efforts and resources. We should not be expecting quick results because of one month's contribution. That is peanuts when you compare it with the amount being spent against us.

    It is high time people join the state chapters and try to lead them if your state chapter is dormant or inactive. Action items will happen but we need to be ready. Try to get more people in IV. The mantra for success will be mass participation in the coming times. It should not be a couple of hundred phone calls or faxes that happened last year, but hundreds of thousands of calls, faxes and thousands of meetings.
    If we can achieve that then we will definitely increase chances of success significantly this year.

    This community needs to think how it can increase mass participation on IV and bring everyone waiting in line on IV platform.
    IV core needs to come up with new campaign too. if not now, then say 3 months from now. it definitely needs to come up with something ..either to highlight our problems / contributions or for something like recapture.
    without meaningful campaigns, increasing memberships or donations is an illusion !!!

    Hello friends,
    My birth certificate has the following information
    date of birth, Mothers name, fathers name, place of birth. It does not have my name and i am from India. Is it ok.. or should i get one with name.

    My PD is not current but i am getting ready with all the documents, just in case it gets current.

    I am in the same situation. My attorney advised me to have one with my name if possible. I scanned mine and my wife's Birth certificate and sent it to my Dad in India. He said that he will get the original in 2 days. Looks like it is a straight forward process. You could just send it with a copy of ur passport.

    P.S: They would need the copies to be notarized before taking it to corporation or municipality

    I think it made a lot of sense to me ... Here is the article in its entirely. It kind of matches with sobers and nyte_crawlers descriptions above ...

    "President Bush has set out his goals on immigration reform to the American people. "There is," he said, "a rational middle ground between granting an automatic path to citizenship for every illegal immigrant, and a program of mass deportation." I agree that a rational middle ground can be found -- but amnesty is not the middle ground.

    Instead, I will soon be introducing legislation, the Border Integrity and Immigration Reform Act. This bill is tough on border security and tough on employers who hire illegal aliens. It will include a guest worker program -- but it will not include an amnesty (nor require a huge new government bureaucracy to administer the program). I believe this legislation is a strong alternative to the amnesty plan passed by the Senate; and I hope that it will serve as an attractive alternative to my colleagues in the House of Representatives.

    Since immigration reform must begin by securing our border, my plan incorporates the Border Protection, Antiterrorism and Illegal Immigration Control Act, already passed by the House, in its entirety, with only minor changes. Thus my plan will add port-of-entry inspectors, end the policy of "catch and release," put to use American technology such as unmanned aerial vehicles, require a security fence to be built across our southern border, and require the Secretary of Homeland Security to certify that all these border security measures are substantially completed before any new guest worker program would begin.

    But my bill does not include a so-called path to citizenship, i.e., an amnesty, for the some 12 million illegal aliens in this country. Instead, it insists that they leave and come back legally if they have a job opportunity in the U.S. They will be allowed to do so under the terms of a guest-worker program that will be implemented by firms in the private sector, not by a new government bureaucracy.

    Private worker-placement agencies -- "Ellis Island Centers" -- would be licensed by the federal government to match guest workers with jobs that employers cannot fill with American workers. These agencies will match guest workers with jobs, perform health screening, fingerprint them, and convey the appropriate information to the FBI and Homeland Security so that a background check can be performed. Once this is done, the guest worker would be provided with a visa issued by the State Department. The whole process will take a matter of one week, or less.

    My immigration reform plan does not favor illegal immigrants. Anyone may apply for a guest-worker visa at the new Ellis Island Centers; indeed, the plan may actually work to the advantage of applicants who have never violated our immigration laws, since guest-worker visas will be issued only outside the U.S.

    There will initially be no cap on the number of visas that can be issued; for the first three years, the market and the needs of U.S. employers will set the limit on the number of guest workers. This is necessary in order to provide the incentive for illegal aliens in this country to self-deport and come back legally. After three years, however, a reasonable limit on the number of these "W" visas will be determined by the Department of Labor, based on employment statistics, employer needs and other research.

    Nevertheless, there will be a limit on the amount of time guest workers can spend in this country. They would be allowed to renew their visas, but only for a period of up to six years. And in order to receive their first renewal, they would be required to study English and pass an English proficiency class.

    After six years, a guest worker must decide whether to return home or seek citizenship. But he will do so under the normal rules and regulations of our naturalization laws. There is no path to citizenship in my bill.

    Lastly, my immigration bill includes strict employer enforcement. It does so by incorporating the employer-enforcement provisions contained in the House-passed Border Protection bill. Thus, there will be established a nationwide electronic employment-verification system through which employers will confirm the legality of each prospective and current employee.

    Employers who choose to operate outside the system would face stiff fines. Once the new enforcement system is in place, jobs for illegal aliens will dry up.

    As the grandson of an Irish immigrant, I believe in the ideals enshrined on the Statue of Liberty in New York Harbor. America always has been, and always will be, a welcoming nation, welcoming under the law any and all with courage enough to come here. But a nation without borders is not a nation, and across this country Americans are anxious about our borders.

    Every night Americans see news images of people crossing the border illegally. They hear of people paying thousands of dollars to "coyotes" to smuggle them into the country; they worry that drugs will make their way into the hands of their children more readily. And they rightly fear that our porous borders make it more likely that terrorists will cross with deadly intentions against our families.

    I believe that my Border Integrity and Immigration Reform Act is a solution that those opposed to amnesty and those who propose a guest-worker program can both support. It offers a solution that those calling for the humane treatment of illegal immigrants can embrace.

    And I believe that this solution is one the American people can embrace. This is the real rational middle ground."

    I agree with your message that immigrants should clear their dues before they leave. I'm of the belief that, even if they complete 36 points in Social security when they leave, they should leave honorably without any dues/liabilities. That is the choice we made knowing the repercussions.

    Having said that, the way you pursued your argument in the context of non-GC holders having a home is not correct, in my opinion.

    Yes, I don't believe we have anything against each other except replying to each others posts! :D

    And I don't want to get between you and masternyc! :-)

    When you reply to me and use the word "you", it could be taken as personal instead of treating that as an impersonal pronoun!

    "Make sure you pay off your mortgages if you do and cover all your liabilities" could have been rephrased as "Immigrants leaving MUST ensure that they pay off their mortgaes" with a strong emphasis on 'must'
