    The fact is it looks like you don't seem to understand the magnitute of problem as logiclife is trying to put forth. Its not the question of 10% or 25%. If this law passes, It would be hard to get hired by a prospective employer, transfer or extend your H1B, As they would back off from employing H1B's. So no Microsoft or IBM would be willing to spend time trying to prove that they need people on H1B. Not just Hi-tech sector but this law would affect each and everyone who is currently on H1B or who are trying to get on to H1B. It would be stupid to think that once everyone one is gone, you could pick those left behind because these jobs would start moving out of the country in a much larger scale than you could imagine.


    This is actually a very good idea. Maybe not 10% even 25% is fine.
    This way microsoft, oracle etc. can get their workers.
    Even Deloitte, PWC they hire americans and pay you when you're on bench.
    Unlike most indian consulting companies, which don't pay you when you're on bench and make you lie on your resume.

    the consulates usually help getting a new passport, visa etc on all days of the week (including weekends). You just have to provide adequate information about what the emergency is.

    I never saw anything like this it is far worse than the government municipality office. There is only one lady at the counter nearly 200 people waiting. She is doing things at her own pace. They were fighting over missing $10s, nepotism etc,is prevailing, they have an official line and an unofficial line. It looks like a shack than a consulate. Burger shack is better than India Consulate. After more than a month I am still waiting for my PP.

    I went to the DC embassy to submit my passport on December 9th. The line was long and the lady was efficient. the only problem is if you don't have any of the docs, you are out...need to come back again..and the DC website is the worst of all...does not give all the documents required. I had all of mine and was done in an hours time. I was asked to come back on Jan 29th thats a month and a half later.

    I come back and the place is like a movie ticket counter for the first day first show..no queue..not organized...people just walk in the front of the counter and gather even though they see a line..also the lady at the counter was RUDE...throws the passport right at you...there was favoritism to the department of state guys who came seeking visas!

    I didn't think that EB3 ROW will be "Current" in June. What I meant was that Illusion's PD will be current because he is only 3 months away from May cut off dates.

    This is the selfish part of me speaking but I hope they don't become current but move to April 2008 or something similar.
    If EB3 ROW is current then that opens up the numbers to EB3 India and China and we saw last year that India alone got 17K approvals so that cuts from the number of ROW approvals.
    Again ... it's the selfish part of me ... in a perfect world, nobody would have to wait this long or make these claculations ...
    I'm happy for all the people that get that "card ordered" email but I so hope to get one for myself!!!!

    Or
    it is possible that SA 180 is merged with 187, as I read ( I can post) the Senate discussion verbatim and Senator Kennedy introduced SA187. And the CR record has these confusing.

    Hta's great, I really hope Atlanta would start moving. Mine is over a month now but there are lot of applications over 90 days.

    My lawyer just filed my labor on monday he gave me a
    number A-0XXXX-XXXXX . is this a valid format for a labor receipt. I think he applied through Detroit DOL. It is under EB3 and how long does it take to get approval.

    Hi!

    My friend (in the US, on J1, no HRR) has been offered a position with a Non profit organization. They do not have experience with H1b process and want her to tell them about the process, and how she can work here legally (starting June).

    I understand that she will not fall under the quota and does not have to wait till Oct 1st. Can someone please provide information (some links) on the following:

    1) Can one do premium processing for H1b (first time for her), even though it is a non profit organization? Or is premium processing only for cases that fall under the cap?

    2) I noticed that the fee is:
    - 190 for application
    - 500 for fraud security
    - 750 or 1500 depending on whether there are 25 or more employees
    - $1000 premium processsing
    - $$$ for the lawyer to prepare and file the petition

    Is it required by law that all the application fees be paid by the Employer, or can it also be paid by the beneficiary? I understand that the permium processing fee can be paid by the beneficiary, and perhaps the lawyer fees too.

    3) Does the employer need to get any certifications/approvals from the Labor department before filing for H1B?

    4) Can the entire process by done online?

    I will really appreciate it someone could help with answers to these questions.

    Various reasons...time...schedule...other obligations etc...lack of readily available information on IV as an organisation or state chapter....too many steps to do simple things like joining the state chapter :)
    ya some of the reasons seem ridiculous...

    like the example of the weekly attorney call
    Many like me don't have the time to search through forums as to what the number is for the call or where is the link for the chat. If its displayed on the main page "Click here to join attorney call" that would be so much easier and encourage a lot more participation.


    No member has to search for the lawyer conference call thread in the forums section at all. They just have to read the threads running on the home page!. Every week that we have the conference call, the thread runs with the red title "Free Conference Call on -date- -Lawyer name- frm -firm name", and it is mostly me who keeps the thread alive from Monday through Thursday! I have even started a thread on the Ask the lawyer section announcing this and I kept the thread on the home page until the third week of this month - when we had the last call for the month of March. I have not kept it up on the home page with all the advocacy activities we are involved in - but I would think that the members who benefited from the calls would want to help by keeping it up on the home page...........but that does not happen either (although wait_for_ever_gc and SGP tried for a few weeks).

    This is exactly what I mean when I say "frustration" - The services are clear on the title and runs on the home page every week. Yet members say, I can't find it!

    I have had people PM me and ask how do I post on IV - I point them to the thread that tells them to do it - we do have it as a sticky, for easy visibility if members take the time of doing a little search. I have had members call me and ask how do I post, I have explained it to them while on the call. There is only one ph# available to reach IV - and I have answered everyone of the calls for which members have needed help.

    ok i managed to find it...but its not easy to find...the average person visiting this site will never know about it. This is a cool benefit...it should be advertised on the site more so people can take advantage. It will certainly generate more interest in IV

    Right here, members should realize, IV is not here to market stuff or make money. IV is about services and working together to bring the relief needed for our immigrant community. Does IV need the money? Absolutely - for advocacy. Not just the 3 day advocacy event but the year round advocacy that needs to happen to get anything done.

    IV has a donor forum, and it has made a policy that to be able to get access to it, members need to donate. It is not a mandatory service but an option of choice for each of the members. Without making any monetary payments mandatory, IV members (some) have issues with it. I cannot imagine the uproar and backlash that will come, if IV decides to impose even a $2 mandatory fees. People will find fault with that too......... And if there is one thing we have realized, we can't please everyone. IV leaves the option of donating as a choice to our members rather than a mandatory imposition of fees.


    I will say this though, Aman is a good friend of mine, and he himself being in EB3, waited for many years to get his GC. Before he got his GC, he too was frustrated with the system and came up with this organization - over a conference call - to find solutions to make this GC process better. This was in end of 2005. He got his GC in the recent past in EB3, and yet here he is fighting for the cause of the people who are still stuck in the backlogs! He has a full time job, a family (who is sacrificing a lot because he is so involved in finishing what he started, a time that he could have spent at home), and he works harder than anyone I know for your Green Card relief. There are very few dedicated people behind IV, and Aman is the very back bone of this organization.

    Members write about IV being for EB2? How? Members write about how IV does not understand the pain of an EB3.. Really? Aman and Pappu and other team members are all in EB3......some still without a GC......waiting just like you! This organization was built on EB3 pain and it continues to exist because of the dedication of few leaders to see this through. A lot of people got greened in 2010 - where are they? Some visit, some even donate regularly, some even participate/volunteer for the advocacy days in DC. But the large majority left. If Aman decided to leave after he got his GC, each of you would have found another online place to go to, but what you may not realize is, had he done that, there would be 1 less dedicated, passionate voice fighting for your speedy Green Card!

    The other day, a member since 2007 - does not know what the goals of this organization is! Even my child knows - that to find out about any organization - just go to the "About Us" section. Four main menus to explore - "Home", "Forums", "Wiki", "Advocacy" - you will find everything you need to know about IV.

    Members don't want to see what is in front of them (Free lawyer conference call on home page)

    Members don't want to explore a little bit about this forums - (Take 10 minutes of your time when you visit IV to look up on Advocacy, on Wiki) - to get the info needed.

    Members don't want to participate in anything - like I said - IV has this action item of meeting with lawmakers - and the response is "I can't, as I have a busy schedule, other commitments......" All I am asking for is an hour off from work to meet with lawmakers in a month. 1 hour in a month!

    Members ask what has IV done for me? I won't even say 'Ask what have you done for IV" - instead I will say, "Ask what have you done about your own green card other than wait."

    A member thought Pappu's post was "arrogance". But does this member know that Pappu is the one who handles these difficult issues - researching what the problem is and then suggesting the next steps or contacting the right officials to get the answers for these needy members. IV does not charge for this time and service. But he hopes that this member will donate. And he has rarely found these very members coming back to donate to IV. And that to me is "frustration".

    You may want to believe what I am saying or not - the choice is yours. But I will ask this of each of you - if you have something negative to say about IV or don't know what IV is working on - just pick up the phone, call and ask. Before you criticize the hard work of people, take the time to get your facts right and then do what you feel is right.

    BTW, all "you" mentioned here is every member and not directed to one person. And check out my signature - finding your state chapter and becoming a member is easy. I have had this for over a year now.

    Most of people are getting. Your case may have some issues. Or it may be in hand of person who is on week or vacation. Date current means no guarantee that you will get on day 1.

    If you don't get with in 30 days , you should contact USCIS or ask IV to help. Pappu already created thread if any one not getting approval and are long time donor should contact IV so they can dedicate resource.

    Thank you for your stupid and negative response. Mr. Pappu is helping only Donars.. I am not a Donar.

    Thanks for signing up. The good part about these events is they are both Walking and running events so newbies should not hesitate to Join. We picked an event in Houston because Texas had the second highest number of letters for the Admin Fix campaign :)

    I am in - along with my husband (and he is going to kill me for signing him up ...he he) for the Houston 5K run - lets start with that and see if I can finish..I'll take on more if I have success with this!

    BTW, there is also a kids run for children ages 5 to 15 (K - 8) - my kids won't qualify for it, but those that have kids in this age group can truly train as a family.

    F1 - H1, never paid a single penny to any attorney in last 11 years, i did all paperwork by myself.

    Joined IV by many names. i am part of IV since beginning, even before Pappu

    Hello Gurus,
    I have a question as follows. I was with an old company and transferred the H1 in the 9th year to the new company. I already had my Labor and I-140 approved with the old company (EB3-I Category).
    After switching to this new company I had to start my PERM all over again as I missed the July 2007 boat and could not file for I-485. My new company is based in L.A.-California. I am already drawing my salary from new company. They only have office in L.A. I work for them from my home office in NJ. Today the company's attorney called & asked me that I needed to have L.A. residential address as it is required to be stated on the application. I have no intentions to move to L.A. in near future. I am in a fix now as to how to go about this. I will appreciate all you gurus and experts advice and also please advise me repercussions if any.
    Please help.

    My wife is in India for the last year to get new H1-B (6 years completed)
    She has a valid dependant visa till May 2008

    Based on new rule, she applied to reclaim 3 years of H4 for H1-B.
    H1-B is approved, she is going to Chennai, India for stamping.

    If for some reason H1 is denied, can she come back as dependant?

    You can file PERM for future employment while on H1 with a different employer.

    While this is an important issue, it could be largely addressed if backlogs are eliminated, thus speeding up the adjudication time. At this time there is no specific charter to address this issue, however, this is a problem that persists across the spectrum, and not only in employment-based immigration categories.

    (I will bring this to the notice of the Core Group, however, one should take note that we cannot have a very broad agenda, as it would be challenging for us to approach Congress with requests).
