Aliens and Nationality - 8 USC Section 1571
Sec. 1571. Purposes
(a) Purposes
The purposes of this subchapter are to -
(1) provide the Immigration and Naturalization Service with the
mechanisms it needs to eliminate the current backlog in the
processing of immigration benefit applications within 1 year
after October 17, 2000, and to maintain the elimination of the
backlog in future years; and

I had a reqruiter discussing a great job opportunity and finally when it came to the status thing, it was my mistake, i said "I have EAD". She said "That's fine" and never got back to me, she said she will be in touch via email but never did that.
So this is a pattern now.
Reqruiters and HR know they can say "Sorry we do not sponser visas" so they say it without any issue but not EAD.
I am just baffled as to why are some people so fussy about EAD. Isn't EAD holders a piece of cake for the company? People with skills and eligible to work for any employer????
I am sure the hiring managers would love to bring good people on board. But unfortunately, these reqruiters and HR are creating the mess.

I just received my 2 year EAD. Priority date is Nov 2002 - EB3 -India. Well I guess that says it all. If USCIS thinks that Nov 2002 will take at least another 2 years then I dunno what about the rest. I didn't wanna think about EB2 porting being so close and spend another 10k, I guess just need to stop worrying about it now. :)

I am in for this.
If some one has entered US legally and filed for GC, it means (most of the cases) they will wish to naturalize at some point..Technically once GC is approved path to citizenship steps up.
I like this idea of pushing for citizenship..but I would like to remove the clauses of measuring length of stay from 140-approved or 485-applied etc.
Why shouldnt we say, anyone who worked in US for 5 years (which means paying taxes etc)
should be naturalized directly ...When they can make illegals legals why not us?
Do we have a group in Linkedin? If not, I can take up the responsibility of spreading through Linkeid groups for support (I dont like facebook so I am not on it and Linkedid is supposedly a professional network)

I am not sure what is happening. When I went to USCIS during Infopass, the officer at the time told me that my case will be looked upon when the notice date comes up.
MY priority date is april25 2006 and the notice date was 09/18/2007. I didn't believe him. Even I raised the question in one of the forums and other guys shot me down saying the notice date is not important. But now I got an LUD on 09/19/2007 and that was the reason why I raised this question to you as well as HIINVIN66. I am assuming that the applications are looked upon based on the notice dates. If they under EB2, pre adjudcated and visa numbers availaible, MAY BE MAYBE we get green cards. IF not, We have to keep our fingers crossed. Let see what happens.....

The House Judiciary Committee marks up legislation this week to change that, representing likely the only measure Congress may take in the remaining weeks to aid innovation, the economy and the competitiveness of U.S. companies.
H.R. 5882, authored by Rep. Zoe Lofgren (D-CA) and Rep. Jim Sensenbrenner (R-WI), would reduce wait times for green cards and help retain talented people in the United States. It would do this by providing green cards that had been allotted in previous years but went unused, primarily due to bureaucratic obstacles.
�A developed country�s competitiveness now comes primarily from its capacity to innovate � the ability to create the new products and services that people want,� according to Curtis Carlson of the Silicon Valley research firm SRI International. Skilled immigrants are a vital source of America�s capacity to innovate.
The National Venture Capital Association reports that 1 in 4 publicly-trade companies that began with venture capital since 1990 had at least one immigrant founder. While the vast majority of employees at U.S. firms are Americans, when U.S. employers recruit on college campuses they find foreign nationals represent a high proportion of the graduates in key fields. In 2006, 73% of new electrical engineering Ph.D.s in the U.S. were granted to international students, according to the National Science Foundation, while in 2005, foreign nationals received 55 percent of electrical engineering master�s degrees and 42 percent of computer science master�s degrees.
H-1B temporary visas, which have been exhausted each of the past 5 fiscal years, only allow individuals to stay on a temporary basis, so an employment-based green card is necessary to stay here permanently. The separate quota for green cards for skilled immigrants is set at 140,000 a year (including dependents of the skilled immigrant). That quota has also been insufficient to meet demand, creating waits of 6 to 10 years for a green card.
The great uncertainty these waits create lead some to give up and leave the United States and others to not even begin the process. The current long waits �cause a reverse brain drain affecting American competitiveness and innovation,� according to Aman Kapoor, executive director of the group Immigration Voice. �At the same time, these green card backlogs create severe quality of life issues for the applicants and their families.�
Those who understand markets realize that there is no such thing as a fixed number of jobs, as critics of high skill immigration maintain. A 2008 National Foundation for American Policy (NFAP) study found that for every skilled foreign national requested (for H-1B visas) with the Department of Labor, U.S. technology companies increase their employment by 5 workers. Many U.S. executives confirm this experience at their firms. Looking to America�s next generation of scientists and engineers, a 2004 NFAP study found more than half of the finalists for the Intel Science Talent Search, the leading contest for top U.S. high school science students, were the children of skilled immigrants.
In addition to the reduced waiting times for green cards from H.R. 5882, Congress can take other steps. It can fix the labor certification process for skilled immigrants under which the U.S. Department of Labor (DOL) requires companies to engage in expensive and time-consuming advertisements to show no qualified Americans are available for certain jobs. Neither the law nor the original DOL regulations required such advertisements. Yet DOL is using its questionable authority to, among other things, audit thousands of green card cases from the nation�s largest immigration law firm, Fragomen, Del Rey, Bernsen & Loewy. The Fragomen firm has filed a lawsuit in U.S. District Court alleging DOL has exceeded its authority. Congressional oversight is warranted.
Congress can also eliminate the per country limit for skilled immigrants, which pushes back wait times for Indian and Chinese professionals, exempt from green card quotas those who earn a master�s degree or higher, and increase the quotas for H-1B temporary visas.
While H.R. 5882 will not solve all our immigration problems, it represents an important effort to retain talented individuals in America so they can help create jobs and innovation in the United States.

America will fly even higher with or without India and chinese those days are gone, look into the future. In the past not many american used to take science and Technology filed but now its different.
I beg to differ on this argument: I am recent graduate from a top engineering school. In my class (class size varies according to the course, anywhere from 80-120)
The only people who took engineering were ones sponsored by compaines like Boeing and Raytheon and that too they were always above 35.
Of these in a class of 40, i would find one american. In my undergraduate courses, there would be 3 in 40. Of those atleast one or two would be pursing double degrees - Music and Science etc etc ..
So... fact is that 95% of the american youth hates math and science in college. Just a look at companies in the bay area will tell you more.. most of the Americans in technology sector are all over 35. Very rarely will you find a fresh grad hired in these companies because they are not available.

Congress have a bigger issue on their plate right now. That is Iraq. I am pretty sure Congress would take up this issue in near future. Make your voice heard to Congress. Then pray to God/Almighty.
PRECISELY My point. First it is IRAQ, then it will be the Presidential Elections then something else. The Government has NO time to question the USCIS and NO real motivation either.

Be persistent and you have every right to be after all you came this far.
Write to Janet Napolitano and mention that you are unfairly getting delayed and that you want to know what is holding your application and all checks and clearances done and visa number is available...

There will be only 25 - 20k Spill for 2010. Given that India and CHINA Eb2 can cross mid 2006.
It will take another 2 years for Eb2 to make C and then we can see Spill over to Eb3.
If economy improves and we start seeing labor approval coming Spill be going to less and creating more wait time.
Eb3 needs VISA RECAPTURE badly. Eb2 guys can wait for couple of years to get GC. but still 2-3 years in given economy is too risky. Bottom line is WE need VISA RECAPTURE in order to clean all mess.

How do you know that experience in Canada or Mexico will be any different from experience in India? It can be only better at a consulate that hasn't yet implemented PIMS, which I don't think there are any at this point. At least you are at home with family. I think the worst is to be stuck in Canada or Mexico for a month. I think the moral of the story is to use AP whenever possible.
I personally know at least couple of friends who went to canada in the hopes that they will get the stamp earlier. But both of them were stuck because of PIMS for weeks. One was stuck for 6 weeks and other 5 weeks.
So I do not think revalidation in India or canada or mexico really matters.

So thats just somebody's interpretation of letter campaign.
