Hi,
I am a one time donor of $50 and not able to view the donor threads. If there is some extra step to be done by Admin for my User ID to grant permission or i don't qualify to view this thread. if i am not qualified what is the minimum qualification?

We need some numbers to back this up. I think you are saying EB2 will not become current even with the recaptured number. There is another thread for requesting numbers from USCIS about pending applications per category, per country. So, participate in that campaign as well.
We need the numbers. I would have guessed roughly 50% of pending 500K applications are from India, 50% of that is EB2, so recapture of 200K visas should help.
I am saying Recapture will only help EB2 and not EB3. Bcoz all the recaptured numbers will be used by EB2 first. So EB2 dates will move forward and then people with PD in 2007 and 2008 in EB2 will use up captured numbers and EB3 will still be waiting to get any leftovers.

Your rocket science of 'report' to employer manager can be easily busted just by producing couple of emails from client managers assigning work to these L1 babies... true these companies would have a so called psuedo manager in their client locations just to fool USCIS BUT unfortunately ICE investigators are trained and informed about such fraudulant arrangements. Once we produce couple of emails (hope atleast few of us would be copied in those work assignment / weekly status emails) proving the direct work assignment from client these phony arrangements doesn't hold good. Second if we could prove that these so called managers doesn't even belong to our team (look for org charts/team list/email lists where these phony managers name would never be mentioned) just produce those evidence along with the above mentioned work assignments.. ICE investigators would take care of our 'rocket scientists'.

This is good but the numbers are very less to do anything in the bigger picture(EB2+EB3 pending). Atleast something is better than nothing.
Hope this doesn't lead to laxing on the advocacy day agenda or less efforts from EB2 people on the verge. EB3 people stuck wtih pre -perm labor, no substitution should also be helped, and way to do it , recapture of unused numbers, hold on diversity lottery. Going through advocacy efforts. A united effort has a higher chance.

As such, you have to start looking for other jobs because you are not sure if they will accept EAD even after a week.
If they offer you the job, well and good, but if not, I think you can litigate for various reasons because what they did is not right.

what is the meaning of staff augmentation case? He work at client place and client is administered project.The s/w tool is copyright by client.The reason for asking him to come back is that prior to this company he worked for another company for two years. He left his old company before 5 year. when he joined his current company he has provided all the document mentioned in checklist such as offer letter, exp and releiving letter and last two month pay stub and they did BG for same document.During 5 years career he worked for diff client and everytime they did BG for him before putting him in project and there was no problem happen in his BG. recently his current employer find something wrong about his prior company and they asked him to provide more evidance for prior company.now he don't have any contact of his prior employer and he does not have any more evidnace for showing their company.
Because of this reason they are asking him to come back home country from last two week.He told his company that he tryed to connect his prior employer but he can not make out and he don't have anything more to show the company.
Please suggest what he can do in this situation.
If anyone come across in this situation then please reply to my question.

cir failed because the senate did not have a filibuster proof majority (60) to pass cir. This time the democrats are expected to gain 4 to 5 seats in the senate, that will take there majority to 54 or 55 from the current 50 (49 +liberman). With a majority of 54 or 55 the filibuster will not happen again in senate and cir will pass in the senate.
The difference between Bush and obama in calling for cir is that Bush was an unpopular lame duck president, his party was a minority in both the house and senate. Obama if elected president would have the democrats in control of both the house and senate, therefore when obama says he wants to pass cir, it will happen, so take it seriously and dont live in a fantasy that CIR will fail again.

Please note the response I got from the attorney of my previous employer (the one who revoked)
This is exactly what I previously explained and what XX verified for you. The I-140 was revoked/withdrawn and the labor certification was substituted. If only the I-140 had been revoked/withdrawn then you would still be portable. However, as XX confirmed, the company used the case to substitute another employee.
Clearly the ex-employer and USCIS are at fault. I have the approved I140 and to date on my uscis portfolio it states that my I140 was approved in Feb 2005. I changed jobs in June 2006.
I am so &^^%$#@ tired, that if this does not work....I am going back. Enough is enough.
Don't loose your heart. I know this is a serious situation but do not become emontional, just stay calm. This is clearly a confusing situation and a bad move by your employer. Have you got a good attorney? Just consult a good attorney and go with what s/he says. This is not your fault and before thinking of going back, fight for yourself and your family. Some ideas are good. In order to implement them, we need support from members. Pls volunteer and take up the ideas to lead them. For example I have mentioned about poster and banner campaign. If each one of us, prints them and post them in various places, we can get good publicity.
We have to make do with such low cost volunteer work. Someone pointed out that we should contact newspapers and get articles published. Wish it was so easy. We have written tons of mails but that alone does not work. You need to issue press releases and publish them online. Publishing them each online costs a couple hundred dollars by publishing services who distribute, and there is no guarantee it will be picked up. Thus you need a focussed campaign for it. There are services where you can contact reporters and media on a specific topic and send them email, press release directly. If they are already writing article you can know the deadline. When we can hardly get contributions of 5k in 4 months after collecting $5 each, it is tough to plan a big media campaign. The reason why other big organizations and big anti immigrant orgs can get so much publicity is that they probably can spend their huge resources on such services. They can also afford a full time staff. We do not have all that and run IV along with our full time day time jobs. So the first thing we need to do before we run any campaign is to get more members and more contributions and monthly signups. Without that ideas may only remain on the forums.

We have to make do with such low cost volunteer work. Someone pointed out that we should contact newspapers and get articles published. Wish it was so easy. We have written tons of mails but that alone does not work. You need to issue press releases and publish them online. The link is related to the fingerprinting background check. Almost 100% of the time the automated system returns an FBI record (an existance or not of a "rap sheet"). Only in rare cases when the finger prints are not clear USCIS sends a new FP notice.
The issue here is the FBI name check which returns less than 68% in the automated response. Around 32% of cases (485/n400) are delayed of which less than 1% really may have a negative record most of which are reported by IBIS and finger print check.
FOIPA only provides main file check report (not reference file report) which in any case is worthless for most applicants who have never committed a crime but are stuck in the name check due to a flawed soundex alogirthm that is applied for both roman based and non roman based names. Invariably Indians, Chinese, Arabs and Russians (and slavic names) are caught up disprortionately.
Mr. has been lately tightening the screws and USCIS has to report in the next 30 days the response to his anual report to congress where he listed the FBI name check as the most pervasive problem affecting 485 and naturalization applicants and the fact that name check backlog grew by over 100,000 in 2006.
Name check dissproportionately affects Indians, Chinese, Russians, slavs, Arabs and Muslims.

USCIS is supposed to respond to USCIS OMBUDSMAN report on Sep 11. USCIS has not mentioned about the value it is deriving out of the NAMECHECK process!

All these requirements are Position Specific. Before publishing externally, most companies (HR) decides the policy first for an example to which kind of person they will hire for this position like " We will not consider H1 for this position" seeing the "Critical and essential need of "blah " blah"..." And they then follow it. So it may happen that one person gets an answer " We do not consider EAD holder for this position.." and next month you may meet somebody (EAD Holder) working for that company on EAD but for different position as company made apolicy to hire EAD holder for that particular kind of position.

It is possible to use your new approved 140(EB2). Your date are current and do request USCIS and go in front of GC line. Good luck.

I have applied my I485 and EAD based on EB3, I have received EAD for me and my wife, in parallel I had also applied for I140 based on my EB2 application. Now my I140 has been approved for EB2 and PD is current for EB2. I was wondering if there is any way that I can get my I485 transferred to EB2 and how can I get it done...
Could someone please suggest...
