    Here is the reality: The thread is 2 years old and we have not had a group of motivated folks who could commit both time and money for this. In the last 2 years thousands have read this thread and have got greencard, but after getting greencard most people have different priorities in life. Writing posts on the forum asking IV to work on it will not get anything done on this issue. Nobody else will do anything unless those who seriously want to work on it commit their time and money for it.

    They need to be going to fund raisers of lawmakers and contributing to election campaigns etc as a first step to lobbying. We need to see IV green card and citizen members doing this more regularly anyways to help others in line behind them and get more politically active.

    Here is how people can organize this effort:

    If some green card holders seriously want to work on this issue, the first thing they need to do is form a team. Commit for a long term effort. This is not going to be an effort for a few month or days but will take several years. After you form a team, the next task would be gather as many people as you can who want to work on this issue and wish to meet lawmakers. You will also need start-up money to work on this effort. This effort is not as simple as fixing green card backlogs. If we are thinking working on this effort will be as simple as writing emails, then it will not be worth spending time. Be prepared to personally go and meet lawmakers in both your area and DC every couple of months. IV core team has been making trips to DC every month for past 4 years and only then we have been able to bring our issue in focus.

    Citizenship rule change would change the INA and would require lot of support from H1B community, Greencard holders and citizens. It would require lot of funds too. Be ready to contribute your own funds (not hundreds but more than that to start) to run advocacy tasks. IV site is just a platform with a web-forum, but the real work that costs money is daily advocacy operations. Running is site is not expensive. Once the effort gains momentum, you can raise from IV forums from other Greencard members as a separate pool just like we did for FOIA.

    At this time IV does not have the bandwidth or resources to work on this issue. Our primary focus is fixing greencard backlogs so that our members are out of the Greencard Queue. We started this organization for this purpose and we wish to finish what we started before we take on any new effort. Even though some core team members have Greencards, we are all committed to work on Greencard backlogs and will not work on other agenda items in our limited time. It will have to be a parallel team within IV that can work on this issue. IV team can guide as needed but we simply cannot divide our limited time and resources on a new effort.

    There are some docs who are working Overtime and charging $50 or $100 more for Immigration appt ... you might have to dorive down a little bit.

    Try to find a Desi doctor - they can do the Imm check up right now if you pay them more and request.

    The doc i did was charging $50 more for special evening Immg appts - luckily i took appt On June 15th before the rush started and saved some dollars.

    Wish the statement from your attorney is true and we all will be able to file 485 through the month of July with no issue. I'm luckly to get the paper work done and ship the package to Attorney and waiting on their action, But have few friends who could get Medical Appointment only around second/third week of July. Also this EW Other Worker Quota that became unavailable and also rejection of these applications has made us worry a lot, although it is a diffferent category we are at fear that this could happen to us. Reading the VB again, the reduction in the EW annual limit to 5,000 began in Fiscal Year 2002... So this category has only 5000 Visas and I'm not surprised this bacame unavailable and think this category is far more crowded than others... We should be fine atleast in July... May be too optimistic... but nothing wrong in hoping for the best and wish all the members can file asap.

    I spoke to a lady named Susan ( from expatsvoice.org ) yesterday and she told me that she is pursuing with Senator from Florida about making changes in CSPA Act. They have already given some sort of draft legislation to that Congressman.
    I would request our Core Group to join hands with that group to pursue this matter further.

    Good question.
    The first point is illegals have to be paid at american laborer wages. They are currently dragging down labor wages. if the wage is monitored like H1b and set by the govt, enough american citizens of the 15 million unemployed, will take these jobs and illegals will have to leave.
    Most people may not know, there are millions of American farmers, roofers, etc, who can't find a job because of illegals. We compete with americans at the same salary and with the disadvantage of visa overhead.

    Not enough money? This is a big misconception and false statement thrown out by supporters of illegals. here are a few numbers thrown quickly:

    a) It costs 1.5 billion dollars a year to put one armed soldier on every 100 yards of the border. Employment for 30,000 in the army.

    b) it costs about 1 billion to deport 1 million illegals by plane. Do this for 2 years and enough will leave on their own.

    These costs are trivial compared to a 2 Trillion annual budget and b) is a one time cost if we have a). Billions will be saved in welfare, housing, food stamps, education.

    protecting the border is as important as fighting wars, which have already cost 100s of billions, if not more.

    Will talk about H4 later, but the motto has always been - 'best person for the job' at legitimate American wages.


    Mass deportations will NEVER happen. Its too damn expensive and a lot of moral issues come into the equation.

    I agree that border security should be the first step before any sort of legislative relief is discussed for Illegal Immigration. There were 3.5 million illegal aliens in 1986 when amnesty was passed. Today the number is 12 million+.
    While the border can never be made tamper proof, increased surveillance, smarter use of technology to prevent identity theft can make it difficult for anyone wanting to enter the US illegally and find work, here. That would reduce the incentive to illegally migrate here.

    I am more optimistic for something positive to happen with Republicans at the helm than the Democrats coz to take a positive step, you have to be clear on your position. With an unprecedented majority, the Dems could not accomplish anything with regards to Immigration. All they came up with phony legislations, just to keep the carrot dangling. If they were one bit serious about tackling this issue, they would have started to work on the bill in Congress introduced by Guitierrez, last year instead of blowing hot air with a "Schumer - Graham" bill and a "Menendez" bill at the eleventh hour.

    If you think any fraud is going on or there is a law being misused you must complain to USCIS and Ombudsman. Unless it is reported nobody in a position of power will know about it and nothing will be done to stop it.

    I will try to explain the process it takes to get qualified for EB1C.

    You will need to be outside USA for an year working as an Executive or manager. Come back to USA in that role. So the appropriate visa will be L1A. Most Indian companies require atleast 5-6 years of experience before they look at your resume for a manager. Most of the managers now a days get fired if their targets are not met in couple of quarters. So staying in that position for couple of years it self is a big deal. Now they need to prove the candiate valid for L1A position. Face a visa interview and come here and start working. Even if the same company is sponsering the L1A. Compaines usually wait for an year or two before they file I140. This application wll rot in CIS queue for long enough before they get a decision and GC.

    This is the actual process.. If some company works in an apartment in India with one man show and tries to get an L1A, I am not sure if they will get through and get a VISA??? It is quite common that we have more EB1Cs becos, the number of Desi companies have grown. So if you think you are experienced and want to give a shot, try it. These kind of complaints in a longer run will bite us by delaying the applications and building backlogs..

    I think it has become a standard process after any visa bulletin. We try to fight on EB2/EB3 or India vs. ROW or AP in India vs. rest of India. This time it happened to be EB1 vs. rest of EB..

    The system is already screwed.. Lets not add more delays.. If we want to complain, lets complain about the root cause of the problem.. i.e. CIS wasted visas that caused these backlogs..
    Just ask your self a question, if you were given GC tomorrow will you care who comes next or how one comes here??? Atleast I won't. There is a whole department paid to do this job..

    You can day trade. I have been trading for a while in various different capacities. Just make sure you have a good tax guy, they usually charge more for day traders due to all the trade reconciliation needed while doing taxes. Since I got the EAD it has become much easier though. You open a regular trading account and trade. Here is the key to day trading- Risk management, Risk management & Risk management. I cannot emphasize this enough. Most people get in with out much knowledge and burn out fast because of bad risk management. Have an exit strategy before putting on the trade and exit AT that point. Don’t get emotional.
    Key thing is; I quote "Plan your trade and trade your plan".

    Retail brokerage accounts like Scottrade, Ameritrade are OK for regular trading but if you want to day trade they are not good enough. Day Trading is all about execution and you will need a faster broker than these guys.
    Some good ones are Interactive brokers, Think or swim (I think TD Ameritrade bought them out) and e-signal with one of their partner brokers.
    For the guys in and around NY/NJ there are a lot of day trading firms like Hold Bros (Jersey City), Lynx capital and Cymera capital in NYC which offer good execution and good commissions.
    Commissions have to be factored in as you will be trading a lot and all those fees add up. Execution has to be very fast <2 secs or you will loose money in slippage. Another factor with faster execution is that you might be able to front run news which gives you an advantage.

    But before you jump in with both feet, do a lot of research. Paper trade a lot and hone your skills. What you know in equities is just tip of the ice berg. There are tremendous amounts of infrastructure and brains dedicated to squeezing out "alpha" and to beat them is not easy. The real money is in trading options, but this is for the really sophisticated trader. In options you can loose your entire capital.
    Any one starting out must read a lot. I would suggest:
    1. Come into my Trading Room- By Elder
    2. The Equity Trader Course- By Schwartz
    3. Trading and Exchanges: Market Microstructure for Practitioners- By Harris

    For those of you a little sophisticated:
    1. Volatility Trading- By Sinclair or By Johannes
    2. The Options course- By Fontanills
    3. Bible of Option trading- By Guy
    4. Quantitative Trading- By Chan

    If anyone is interested to go beyond this (one step away from insanity), let me know and I can suggest some more reading.
    The key thing to realize is pattern trading is a self fulfilling prophecy. The more you trade the more you realize it.


    I was under impression that being on H1b u cannot do intra day trading.. you can do only routine trading ( dont know excat term ) in which u buy stock and keep it for some time and sell it .. generally 3-4 days..

    Guys:

    I have heard lot of pros and cons about EB1. Let me also say that one of my best friends got his GC from Cognizant in EB1 category which was a fraud case for EB1. I am happy for him but not for myself. I agree it left me with jealousy.

    Now what is our problem? Guys getting GCs under EB1C or we not getting GC in EB3 or EB2?
    If we complaint against EB1C cases, are we going to get GC? Let me tell you, with the anti immigrant atmosphere prevailing in the country, they will even choke EB1C category and use it for propaganda. Do you want to get GC or are you saying, I dont have a GC, even my friend should not have it. This is a classic case of divide and conquer strategy.

    By choking up EB1C, nobody, nobody will get GC. We should not fight amongst ourselves like Eb1, 2, 3 etc Or India , China etc.

    This is a forum for everyone impacted by GC backlog. Everyone involved in the process deserves transparency. First of all we do not know where the numbers are going, whether they are being used judiciously or what are the bottlenecks. Just as we blame USCIS, we also blame Cognixant for our woes. I think first we need to get a clear picture of what is happening and we also need to work with DOS , USCIS to get a clear picture.

    Just like financial companies file statements with SEC, we also deserve complete transparency in the process. This way it will be clear to US citizens who blame us for their woes and also for us who blame USCIS or fake EB1s for our woes.

    We can work with USCIS and lobby them rather than pressure them through senators etc. who are are just using us as political pawns in their elections.

    My final message is: DO NOT do something that will divide the community. Let us work towards a common cause.

    I am not sure how far it is true, but this is the content of the email I got from my attorney when I pressed him to file at the earlierst.

    "As soon as we have these forms back, all of the evidence for filing remaining from you, and I review the completed filing, we will file it. We appreciate your interest in filing on the first day the filing allows. We will endeavor to do that. I should point out that the current bulletin allows for filings throughout July. It is possible that the filings could be discontinued later in July. We are in touch with officials in Washington about this issue and will file your application in a timely fashion for obtaining the benefit when the filing is properly prepared."

    Please don't put any sensational heading on your post if you don't know what you are saying.
    This has been discussed a lot here and is nothing new. There is always a possibility that USCIS can issue a mid-month VB and discontinue taking 485. It has not happened before, but is certainly possible.
    If you thought, the dates will be current from here on to perpetuity...I have no words for you..

    We need active participation from members for the action item listed on this thread. CHC member are taking a very hard stand on the 3 bills introduced by Lofgren. If members (esp. constituents) don't call in large numbers and urge the CHC members to support the bills. The 3 bills may not even see the house floor. CHC members want only one immigration bill (CIR), nothing else is accepted.

    Please ask u'r friends and colleagues (who are constituents of CHC lawmakers) to participate in this crucial action item.

    It is surprising (rather shocking) to see how a discussion on an EB bill (which might never see the light of day anyway) has degenerated into an oft-repeated rant on how IV does not represent EB3.


    What is even more surprising is PlainSpeak is a member from 2006 and doesn't know anything about advocacy and lobbying. Probably because he/she has never been a donor.
    Of course I've seen people who browse other so called immigration/chat forums and pick up wierd ideas and fantasies about lobbying and then post here. Its just mob mentality with un-practical ideas and they think if a mob says its right then maybe it has to be right. yes?
    Then they claim that only they are right (the mob) and we are all wrong and don't know how to do things - strange indeed.

    People can chat, argue all they want on forums, but about 99% of people on public forums know nothing about advocacy.

    This is Great. You dont have to run the entire 10K. You can run part of it and walk the rest. I do that a lot.

    This is a link to other races in the DC area: I have never run a race; so I plan on running one of the 5K races in May or June and maybe try one of the 10K races in August. I am sure there are other races abound in summer. If there are others who are apprehensive about running the 10miler (like me).........you might want to try doing something similar.

    this is not just a question of depriving those who did not come.
    let's please recognise that many people did have genuine compulsions as well.
    the more important issue at hand is that sensitive information should not be released on an open forum. state chapters are free to organize live meetings and brief their members on lawmaker meeting experiences. those who attend chapter sessions are welcome to participate and learn- and join in for future meetings which should continue at the district/state level.
