Lot of analysis. Here is my part. If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always �current�. EB3 including ROW might have been much worst situation than now. EB3-IN will always be in disaster state. Though it is unfair to (EB3) many, this is what the law. In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That�s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Hi everyone,
I have 2004 W2 but cant seem to find my tax return. I have 2003, 2005, 2006tax returns but not 2004. What can I do to get that return. Please any advice will be nice.

My lawyer only asked for the W2 ans tax returns for the last two years. I think the latest two to three years shall be sufficient unless USCIS asks for all specifically.
Are there any instructions specifically asking for W2s and returns for all years of your stay ? or every one is including all they have just to be safe.

Vonage was just responding to the competition.
Lingo has a world plan which included unlimited calling to 30 countries( India not included)
India calls were just 2 cents per minute. I switched to Lingo from Vonage 2 months back. Sensing this mass exodus, vonage came up with an even more aggressive plan.

How is your experience with Lingo customer service. Last year, I tried to switch to Lingo and the lady at customer service is very rude. She is so tired to answer questions and asked me to get all from website. I stopped switching to them.

I came across a couple who got their H1B approvals last yr with in 3 weeks to each other. One of them was in PIMS and other one not. So I feel approval date does not seem to be a criteria to base these delays upon.:confused:

I tried calling KCC and they denied to provide any information on PIMS.
My H1B was approved in Mar 2007 for 7th year extension. I also had my H1 transfer on May 2005.

Well, whether a merchandise can be returned after using, depands on the nature of the merchandise and the level of customer service provided by the seller.
If you are buying a TV or a home theater, you don't know if it is functioning properly until you use it. And returning it within stipulated "return period" is not only legal but also ethical.
Some high-end sellers will even guarantee customer satisfaction by allowing a return any time, yes any time if the customer is not fully satisfied with their product. There is nothing unethical about this. That is why these high-end stores charge you a premium in the first place.
Not allowing return of merchandise reflects the low level of customer service we used to get back home. Obviously that level of service expectaion has been engrained in us so much that we believe returning used merchandise, even when the customer is not satisfied, is unethical.

Over the past couple of days I have had 10 of my friends/colleagues who have signed the letter and they have been mailed out to the president. I also have copies of them to mail out to IV once I have all that I can get..
I plan to call my Senators & Congressman's office's today too. I believe we need to get through to our friends and colleagues and talk about the issues in this letter. I have yet to come across one person who does not agree that our situation needs the attention of the administration.
I know I can get a few more of these letters signed by the end of this week.
Anyone out there who has more letters going out??:D

After staying legally for so long, and suffering due to administrative lapses, I think we must ask for Citizenship. Nothing wrong absolutely. Just compare yourself with your friend who is applying for Citizenship, though you are equally eligible. Dont ask for less. NOthing against who got in.
When you have fulfilled the requirements, then you must get what you deserve.
When we post our requests and stories on sites incl obama'ssite, do make sure you mention about Citizenship also. Its not easy to settle back home with some situations like children etc..

A simple calc to find out how much EB3-EB2 porting going on as of today:
If you look at Demand data released last month by DOS, It lists
Prior to January 1, 2007 , EB2- I pending : 13,200
In my opinion Demand data includes EB3- EB2 porting as well since Demand data reflects overall demand for one category.
Now if you look at inventory data released on Jan 5 ,2011 ,
EB2 India Pending Prior to Jan1st 2007 : 13,516
But if you exclude all the data prior to May = 13,516 - 1,110 - 103 - 133 - 74-108 = ~ 12K
EB2 I demand from the inventory btwn May - Dec 06 = 12K
But Demand data says EB2-I demand is 13,200
Diff : 13,200 - 12K = 1200 ( This number has to be porting)
We know EB2 - I dates have not moved since Oct ,2010 .
So India regular quota for the last six months : 2800/2 = 1400 .
Since dates have not moved, I am assuming 1400 should also be considered towards porting.
so my conclusion is so far 1200 + 1400 = 2600 porting already took place. (though only 1400 really got GC)
What about the 1,194 EB2I cases pending with PD upto 12/31/2005?

Right, but that A# I found on my H1b approval (approved Oct 10 '07) is different from the A # in my 458 receipts.
Just trying to figure out if folks who had an A# in the H1b approval notice are also facing the PIMS delay. (just a wild guess).

I made a service req on sept 6 and they opened it on Sept 30 and assigned it to an officer. They enquired took detailsof my fedex , etc. and now they sent a letter. Just summary "wait wait wait still we need to key in " huh i think many of us will have same fate even after doing all this but i am not giving it up lets do something rather than nothing.

No I don't. You basically don't want to keep the door open wide. Once you are IN you want the door to be closed. You don't worry about loosing US jobs to India/China, but you don't want Indians/Chinese to enter USA and enjoy the "quality of life" you enjoy here.
Nobody enters USA to live a "low profile" life.
You are getting dangerously accustomed to the "taking things for granted" style. You are loosing your competitive skills.
I personally know that more energetic people coming in is kind of dangerous even for my job safety-net (basically I cannot take things for granted). But I still have not learned to think beyond humanity, and I believe sharing is good. The new guys also deserve the chance for American dream.
And I don't forget that I was also once in H1B, and came with a lot of dreams and skills.
However, my point is, if you want to outsource take the job to the low wage country. Do not bring low wages here. I am ok if outsourcing would increase because of the Grassley bill. I am not ok if the low wages are dumped in here. I hope you people see the difference.

Congrats ski_dude12. My personal opinion is that this may have delayed your greencard since July. Sometimes people get too anxious once their date is current and want to try everything that is possible to get approval. There is so much information and misinformation on forums.

Went for first interview on 4th Jan. Got confirmation email today 15th Jan 2008. Got this email about an hour back.

Please drop the following documents off at one of the VFS locations listed below.
1. Yellow pending letter
2. Passport
3. Envelope provided by the consulate (yellow, blue or green color)
