    My PD is current. I have opted for CP when my I-140 was filed. Can I file 485 now?. Do I need to file any papers with NVC/CIS to transfer from CP to 485?.

    Guys, Are we sure that Fedex will not deliver on saturday or sunday, what will happen if they deliver, nobody will be at USCIS to accept right, so it will still be opened only on monday ?

    IUnless id you selected Saturday delivery as special service Fedex wont deliver it on saturday . USICS is sure closed on saturday unless the mail room guy wants some overtime( assume he was a contractor as USICS is employing more contractor these days for the sorting work) and comes on saturday

    Another answer from Rajiv Khanna: on multiple 485s
    I recommend both husband wife file for yourselves and for each other. So between the two , there will be four 485 applications. One: Wife as primary, husband as derivative. Second, husband as primary and wife as derivative. We do this all the time and this is the safest thing to do. You will keep whichever 485 set gets approved, first, the other will be rejected by CIS.

    If CIS rejects the other 485, do they keep the fees or do they refund the fees?

    Hey BP, taking your numbers and assuming horizontal spill over instead of vertical would make eb2 all over current. total spill over from eb1 = 53807, total eb2 quota = 40040, pending eb2 = 74932
    assume eb1 demand = 5000, eb2 demand = 20000

    we can easily see eb2 getting completely approved.

    I concluded the same ( Though never posted that analysis :)) But It looks like we are missing a very critical point - we are assuming that " these pending numbers are the total 485 workload USCIS has" but I referred a different chart on USCIS board and it looks like there is a separte hoard of "preadjudicated" applications already sitting in a queue apart from these numbers.     I am EB2-I with a couple of US grad degrees (and same undergrad school as Rolling Flood, not that it matters to anyone except perhaps those who suppor the lawsuit). And I think this lawsuit is a bad idea because it is divisive and petty.

    There is an old Malayalam story that most people who went to school in Kerala would have read in their primary school classes. Two guys, Greedy and Jealous, pray to God. God appears and Greedy goes, "I just want double of what you give the other guy. All I want to be is to be ahead of him." Hearing this, Jealous says, "God, please make me blind in one eye."

    This lawsuit, like the story above, is a case of knifing others in the back, for no real gain. We should instead try to leverage IV's large membership for a common good, which is what has made IV successful so far.

    The moment I get sufficient number of people I am going all out.
    But as a compromise, I have got a very simple and easy way out...I can tell you one thing, I do have a case which does not require any law change but just the interpretation of it.

    Make sure that 5882 is successful. If it proceeds, I will back down. It is a shame that among 25K members raising 5K becomes a challenge.

    This goes on to show there is no community. If there is not community then I have to look after my interest.

    Since 2004 EB2 is cleared, I am seeing less number of posts being made on IV.Yay I became a senior member, will that mean I will get a green card?

    Dude not all 2004's got cleared..i am still waiting for approval and many more like me are still out there waiting to get greened..dont know when we will be approved..hopeing to get next month..:mad:

    It seems like you are smarter than others or may be you have more insight.
    How come total pre-adjudicated in the chart is exactly equal to total I-485 in the pdf ?
    What exactly total in chart tool means ?
    You might be convinced that you are right but stating that others are asking stupid questions is little too far.

    Its not that I think I am smarter or have any additional insight...but I take things at face value. Of course the total number of pending cases in the chart and in the PDF should match - they both are exactly what they say they are "PENDING EMPLOYMENT BASED I-485 cases" If that's what the report title says, that's exactly what it means. No point in over-analyzing if this is just for pre-adjudicated or only primary applications etc....

    I say stupid questions because people still ask "Does the PDF report contain numbers for dependents or only for primary applicants" - so you are telling me that this is not clear from the PDF report??

    My 140 and 485s (with my wife as derivative )are from Nebraska and have a set of A#s,

    again My wife's 140 and 485s (with me as derivative ) are from Texas and have a different set of A#s..

    how to combine them and make uscis inform abt it???

    Anybody any thoughts !!!

    my lawyer is basically saying: if we get lucky then one gets approved and the other one can be withdrawn at that point; otherwise at some point USCIS is going to issue an RFE asking us to pick one of those two petitions and force us to withdraw one before they make a decision on the other. For now we are sitting tight, waiting to see what USCIS does.

    We had our interview on January 17th in chennai Consulate. Interview was smooth - which company.. how long you were working for the company and what do you do there.. these were the questions. We were told at the end that we will receive passports within a week.

    So far We ( H1B extension -- 3rd time and my wife - H4( 2nd Time), have not received the passports. I already postponed our date of travel to Feb 5th. Looks like I have to postpone again.

    Frustated..
    Calling VFS daily to hear the same news.. Passports not been handed over VFS. The VISA is still under process.

    Called Consulate Twice ... they say they are doing security checks..

    for how long???

    I had already mentioned my EAD status when they had the interview. But after acceptiing it I mentioned it again in the conext of I9 form. Then they said they cant offer me emp;oyment due to my being on EAD.

    This is a pretty big company. I understand that H1B is not protected under anti-discrimination for employment, but EAD holders, specifically those with AOS pending, are a protected against employment discrimination.

    Does anyone have any links to the above conclusion ? I am so tired of this BS. I have spent long enough in this immigration c**p that if I have leave, might as well leave with a fight.

    You can consult another attorney if your attorney is giving you this advice. As far as I know, since you have a valid H1B, you should be fine. I would recommend that you file for all your benefits together (485/EAD/AP)

    - I am not an attorney so use my advice at your own risk.

    It is fine for you NOW that you received your GC now and "see" the plight of IO. You are drinking cool aid now under the awnings of Green card. It is now tough for you to understand the plight of the people on "this" side as you crossed over to the "other"side. It is the same old story of people who got their GC and Citizenship dont care about the people who are going to wait for dog long years. Imagine what would have you done, if you didn't receive your GC in 15 days time, i am sure that by this time you would have shaked the earth from heaven to hell by calling your senators, ombudsman, alderman, congressmen etc. Instead of giving advice to others to understand the plight of IO's, keep your emotions under check and encourage others to do their best. Do not post unnecessary comments.

    buddyinsd is a crap. dont even bother responding to him... his grey matter sends him a signal to go to any thread and vomit. when put in ignore he starts barking to gain attention.

    On the other hand i would strongly encourage people to do what they can do. in my example i have done what a person can do maximum and got positive results. I have even got a phone call from secretary janet's office. loosers like buddyinsd will discourage people to take action for there green card but you guys dont have to stop. it is your fight not this losser's fight.

    life is not all it seems. i came here in 1996. but my pd is 2007.
    i have worked 4 years in an underserved area doing "national service"
    i'm nowhere near a green card, forget that...you even grudge me an EAD.
    i do not expect a gc tomorrow. i did not ask that july become current. but it did. and i lost a lot of money, time and effort to catch the window for an EAD. my family and employer scrambled with me. and got throughly screwed. not by senthil's "mistake", but coldly calculatedly so. in your wonderfully fair world, where does that rank?

    Because you still need a visa to enter the USA (though you have an H-1B approval) and application for the visa abroad is not always easy.
    But if your visa is stamped and not expired, do you still need an AP ?

    This is my case in brief:
    I resigned from company A (who sponsered by RIR LC, and I-140) about a year back.
    Filed I485 using approved 140 of comapny A in July 07, in the485 application we mentioned the details of the current company I am working in. Got EAD and AP approved. (Company A's management is co-operative and supports me to take back)
    Also got 3yr H1b extension approved for current company based on the approved I140 of company A.

    Now Iam traveling to India. Had an appointment in Chennai consulate . My previous H1B visa expired in 2004.
    Will there be any issues with that much gap 4yrs, in getting stamp?
    Is it an issue not working for GC sponsoring employer?

    If I use AP what are the issues?
    If asked at PoE (Newark EWR) why not working with company A? what should be better answer?

    I would like to give update on visa availability. My PD is 03/06- EB2. Opened SR for me and my spouse on 08/30/10

    1. For me, letter by USPS came stating that, I485 is at USCIS local office and will notify about decision in 30 days

    2. Spouse got below response by email (On 09/13/2010)

    "The status of this service request is:

    Your I-485 application is waiting for a visa number to become available. When it becomes available, it will be assigned to an adjudicator to make a decision on the case.

    If you have not heard from the service within 30 days after your number becomes available, you can make an Info pass appointment to visit the Customer Service Division,
    at the District office"

    On 09/14/10 we took infopass and spoke to customer service representative. She told that visa Numbers are not available any more and also checked validity of finger prints in system.

    Told us that they are expired (Till now we gave 2 times, one in sept 07, 2nd one in may 09 (FP are valid for for 15m)) - I guess we need to give 3 rd time soon.

    She told that dates for FP at ASC center are not available and will try to send us ASAP when Visa Numbers are available.

    Did you check if you are under EB2 or EB3 with USCIS?
