    Senate Minimum Wage Bill Avoided Immigration Increases

    It has come to our attention that some believe that the dreadful McCain-Kennedy amnesty scheme was dropped into the bill during its passage through the Senate, but NumbersUSA�s analysis of that chamber�s proceedings indicates that those damaging provisions were not, in fact, amended into the measure before it was sent back to the House on February 1.

    Sen. Ted Kennedy (D-MA) did propose an amendment to that effect, but it was neither substantively discussed nor adopted before passage of the underlying bill. In addition, Sen. Dianne Feinstein (D-CA) introduced and subsequently withdrew an amendment that would have provided amnesty to illegal alien farmworkers.

    On the positive side, Sen. Jeff Sessions (R-AL) offered an amendment to H.R. 2, the Fair Minimum Wage Act of 2007, which would have dramatically increased civil fines on employers who hire illegal aliens. Sen. Sessions called it a �comprehensive wage reform� measure, playing off the �comprehensive immigration reform� term used by open borders advocates. He said his amendment was an appropriate addition to that particular measure � legislation designed to increase the wages of working Americans � because the salaries of low-skilled workers have lagged behind due to the large influx of illegal aliens.

    Although Democratic leaders refused to let Sen. Sessions' initial amendment reach the Senate floor, a second Sessions proposal was adopted that day by a 94-0 vote. It would prohibit any government contractor caught using illegal labor from future government contracts for ten years. It is expected to face serious opposition by business and union lobbyists when the bill reaches conference committee.

    Sen. Saxby Chambliss (R-GA) also introduced and withdrew a positive amendment that would have required that the employers of temporary unskilled foreign agricultural workers (H-2As) pay the greater of either the Federal minimum wage or a newly defined prevailing wage.

    Now I am working with attorney to file my I-140
    I have 3 Years BS Degree in Electronics From Andhra University + 1 Year BS Degree in Computer Specialization from Andhra University.

    Still I am kind of tense about my degree is considered as US equivalent degree. It accepted in H1-B, and EB-3 GC process. I am cross my figures until I get the decision from IO. I will give more updates later.

I am re-joining this and all other IV campaigns actively, now that I am back from a trip to India. I am confident that together we can provide that final much needed push.

    Thx Macaca for the self-filing option. Unfortunately, that is not an option for many of us. Our corporate lawyers are supposed to handle this and they have out I-140 approvals. So not sure how we can self-file... In most of the cases, these big lawfirms are taking days to respond to us, claiming huge workloads.

    I went in personally last month and got my passport the same day through the Tatkal scheme. I just feel spending the extra $150 is way better than anxiously awaiting for it for 3 weeks. I know that they take their jobs seriously over there and the chances of your passport getting lost are bleak. However, there were still a few things that I'd have them do differently. When I told them I wanted my passport the same day, the lady at the counter gave me a shocking expression.:D Then, I was asked to wait for a few minutes just because I mentioned it was an emergency. Not sure how that works :D After 40 mins or so of waiting, when I asked the same lady what was up, she gave me an even more surprised look and asked me 'you didnt get your passport yet?' :D So, I'd advise better be safe than sorry.

    I am sure IV has more experience in this than anyone else in this forum. So I think its better it should come from them. :-)

    This whole doc is put out well. They just need to update wherever necessary. That's it.

    And as for it a law change: whew!. But can work it out!

    Guys, I still don't understand those who keep complaining and complaining about "unfairness" of the system. I feel you, those who are stuck somewhere... and I'm happy for those who can apply, even those who came in 2007. So what? Wishing bad for others is a bad karma... (I started getting into buddist things lately).

    And about fairness.. Is it fair that some people are coming here by just winning the lottery? I'm working with one guy from Ukraine, he came several months ago, sitting with his GC next to me, looking at me having NO IDEA what i'm talking about. Is it fair? No.

    Is it fair that hundreds of thousands come here and get documents by pretending to be "refugees"? You know how to get your documents through asylum? - Simple: just come up with a story (be gay, anti-communist, jehova-witness, whatever...), then you have ONE interview with officer and THAT'S IT!!! After a year you have GC. Half of LA is like that. I know a lot of dudes came a lot later after me, applying for citizenships now. Telling me that I'm stupid that went through that ridiculous way.

    I could become illegale in 1999 and get advantage of Clintons LIFE act. Many did who have citizenships now. Stupid of me? Maybe. Fair? No.

    Is this all fair? No... Everybody has his/her way.

    I'm proposing to make it more fair. Let's just propose mass deportation of American citizens. Make one big immigration line - then it will be fair.

    Mine was TSC...Actually it was NSC, but transferred to TSC during July fiasco..

    Subkamnaa & Congrats friend. My PD is earlier than urs - Oct 05 . No LUD on mine. What is the July fiasco .

    My PD is already current as of now. But there is no movement on my appl - but its just few days past its current status. I am on EB2 with PD of Oct 05 and Serv Center is NE where I got Labor and 140 approved.
    Now I am no longer in that state because my project got over in NE. I am working in CA since 08 and filed 485 from CA .
    Is there something that if I am in CA a different state from where I initially filed labor - it can cause RFE.

    You did exactly what you have accused others of(that is bashing). You could have simply opined, put your point through and left. But you went further than that, I don't understand what is the whole idea of one group passing judgment on others. There are EB2 better than EB3 threads, the labor substitutes vs. honest to God super qualified deserving PERM filers, then there is US educated vs. non US educated and now renters vs. home owner and savers vs. big spenders. What I fail to understand is, if you have to make your point please do so but keep your opinion about others to yourself on your blogs or you personal websites.

    Now coming to the point:

    These people do not want to buy houses not because they cannot afford or they want to play safe. They just don’t want to spend. All they care is Saving, Saving, saving their entire life & keep filling their bank balances. Often strangely both couples are working.

    What's wrong if a couple is saving and filling their bank accounts ? Tell me one thing that is wrong about being frugal ? May be they are saving to for their future education or for their kids education ? For a small business ? or Simply retiring at 40 ? or May be having a bank account full of money gives them same pleasure that you get from your McMansion ? Or they simply want to live debt free and sleep well at night. So unless I have some material possession to show for my money, I am wasting it all away ? Isn't it ?

    These are people who want to live in cheapest rent (even with double income) in single bedroom & they don’t mind children sleeping in their bed room. They don’t mind sending their children to low grade schools.

    If you want to throw your hard earned money and pay the highest possible rents, please go ahead. Don't preach. Public education is free and private school are not cheap so please explain what do you mean by "Low Grade Schools" ? Besides renters can choose any school they want by simply renting in the best school district at all grades. Your point doesn't make sense. Besides living frugally gives your kids a better shot at quality education then overspending on unnecessary things.

    Their intention to come into this country is only for earning money & because they don’t have high ambitions & all they care is saving & not spending, they just think of saving in all possible ways.

    Making money is a perfectly fine ambition is a capitalistic country. May be their ambition is to save early and then provide the best for their family by working part time in later years. Please define "high ambition" ? Buying a high rise condo ? McMansion in a suburb ? Would that instantly qualify me to be an ambitious achiever ?

They can provide food, shelter and health insurance for their family during tough times, they are rich. Unfortunately your views will NOT pay bills, so you can distribute them freely on this forum all you want it won't make a difference.

    Don't insult someone just because he/she is homeless. People do go through tough times and not everyone is fortunate to have smooth sailing all along.     I will reach out to the admins and see if they can provide some templates. By the way, we could use one of the other (issues) templates that were floating around a couple months back. Not sure if they are still there.

    I think that we all should send the letter individually. Why? Because the if each one of us will send, it will look genuine and will remind the DoL each time/day they get a letter. We have 50 some people, 50 letters will make them look into it.

    P.S: good job in finding the plan, its about time that we do something, I dont think any more people are going to come.

    Hi IV members!

    I know many of us have been toying with ideas to increase membership. I wanted to start a separate thread just to highlight the following idea - Every member bring one additional member to IV.

    Specifically, these are the bullet points I suggest:

    1. By December 31, each of you bring one member to IV.
    If you really think about it, it is not a difficult task. Every one of us knows atleast one person stuck in GC process, that is talking conservatively. It takes less than 15 minutes to call one person and explain IVs efforts and request his/her support.

    2. By January 15, each of us take responsibility to get the member we brought to IV to contribute to the cause. And I am not suggesting any particular amount.

    3. Each of take responsibility in having them update their information on IV website, so that when the need arises, they can be contacted (for sending webfaxes etc. like last week).

    Also, whenever you bring someone to IV, please post on this thread (it will encourage others). I feel this approach will work, if we keep this thread alive, and try to stick to the time deadline (deadlines might not have worked before, because they were too long term).

    Also, please keep this thread on track, without any other discussions.

    So IV'ers, lets add ONE member, and get ONE contribution!!!!

    Please enlighten me - the one who proposed this idea and for those who supported this - Why do you think the concerned authorities or lawmakers would listen to you (us) and agree to making this happen? I believe Green Card gives us all the priviliges of the US citizenship except the voting rights. Besides the voting right, what are the significant differences between the two (Green Card vs. Citizenship) that would make a good case for asking for a faster citizenship program?
    GC is an extension of H1B issued for 10 years and gives freedom to change the employer. Citizenship is different and do not compare GC with Citizenship.

    EB1 is the brightest not in all ways. If you are a manger in outsourcing company and in one more country u still qualify for EB1. It does not take long to become a manager in outsourcing companys. So how u can break the law or tweak around it works. I know people who were on bench life long in consulting companies in EB2 got GCs.

    Dear All,

    Can some body please spend some time to help us ?

    Me and my wife came to USA in July 2005 on L1 and L2 Visa�s .We both got our SSN Numbers. Later in Oct 2006 I changed to H1 (Company Wipro), so my wife got changed to H4. We both went to India in Feb 2007 and got h1 and h4 Visa stampings. Our Visa�s are valid till 2009 May .

    Recently I moved to IBM and IBM transferred my H1 to their company.
    My Wife is traveling to India in March 2008 and returning back to USA in July 2008

    1) Does she need to go for stamping because I changed to different company even though the VISA is valid till 2009 may?
    2) We are planning to apply H1 for my wife, but our consultant told me since she will be there in India in April she needs to apply it from India. But she will be returning to USA in July 2008, so she can not go for H1 stamping because she gets her papers in October. Once she returns she will be having only H4 I94 and from October onwards h1 papers. Is there any way that she can transfer her h4 i94 to H1 i94 after she gets her h1 papers. Moreover I think when you are applying from India even you need to mention where you are going for VISA stamping. In her case can she mention Canada? Can she work after she gets her H1 papers without going for stamping?

    BharatPremi, do you know if one can have both 485 and CP processes simultaneously?

    SIMULTANEOUSLY you can't have both. Either AOS or CP. One can covert one from another but it introduces enormous delay. AOS-to-CP atleast 1 year more delay and for CP-to-AOS at least 3 to 6 months delay.
