Unfortunately there is no law that clearly prohibits descrimination based on visa status (at least I am not aware of one). In fact the legal pressure is just for the opposite, that puts additional burden on the companies to make effort in hiring local workers first. The corporation can always say they have a policy to not hire someone with temporary work permit and there is no law against it. It is sad but that's how it is.

According to the law (please refers to DOL agencies- They can help you) NO BODY can ask you if you are a citizen or legal resident during an interview. They can only ask you if you are authorized to work in USA legally. If they ask you if you are a citizen it is discriminatory and you have the right to do not answer explaining your rights. Of course they can discriminate when they are going to make a final desition.It happens in USA a lot. If you have a pregnant woman probably you are going to choose one who is not. But this is not the point. The point is that if you tell the girl sorry but we don’t hire pregnant women they are death!!!!!

I heard that they stopped giving interim EAD's. So all were asked to apply atleast 3-4 months before other wise status will be lost unless you have valid H1. Not to scare anyone but thats what I read somewhere.

in my case i got no slip..whenever i call consulate new delhi they say still under admin processing ?? my lawyer checked with DOS..DOS had sent approval on jan 25th..still under proc at embassy !!
NOT SURE WHY ?? this delay is ??
i maybe forgetting..but which consulate did you go to and if new delhi then what was the description(looks) of the VO ?

My case is pending with IO since Sept 15th and there are no updates officially from USCIS. My question is- what should I ask IO through POJ method on phone? They just tell me to wait.
Should I directly ask "what is status of my application"- tried that once and then was told to wait.

Got the email about being registered as a new permanent resident on Oct 8th. Thanks to SoP, caliguy, fatjoe and all others on the forum who helped / gave me support. I essentially learned that USCIS will not move quickly on their own, they need to be pursued just like any other govt. office in India. I give my time line below for an idea of what I did. If anyone is waiting still, I sincerely think that you should do all of POJ/SR/Infopass/Senator/Ombudsman.
Timeline:
Sept 1st - became current
Sept 5th - contacted NSC several times through POJ. Finally, a very nice lady told me that my case was not even assigned to an officer. Said that she will send in a request to the contractor to pull my case out and get it assigned to an officer.
Sept 11th - Case pulled out of storage area and moved to a smaller waiting room [got this info later, but this is what had happened]
Sept 13th: Opened SR.
Sept 18th - Infopass: Told me that my case was assigned to an officer on Sept 11th (which was wrong really) and that I should wait 30 days. Also told me that my FP were renewed on March 9th and all my checks were clear.
Sept 20th: Contacted Senator's office. Said they will send in inquiry.
Sept 25: Response to SR. Case under review. Wait 30 days.
Sept 27th: Letter from Senator saying my case was under review and I need to wait 30 days.
Oct 2nd: Contacted NSC again through POJ method. A nice lady, Terry, told me that my case was assigned to officer on Sept 30th. She said, "your case was pulled out of storage and put in a rather large holding area where it was till Sept 30th." Also confirmed that my FP was renewed and other checks were clear. Said, just wait, it will happen soon.
Oct 6th: Sent 7001 form to USCIS Ombudsman.
Oct 8th: Got decision email.
Learnings: Pursue your case as much as you can. Call NSC, but be polite. They are usually in good mood on Thu/Friday evenings and if you make some small talk, they will help you. I kept records of which NSC IO is rude and if they picked up the next time, I would just keep the phone down. In fact, the lady who helped me remembered me 'coz I managed to reach her 3 times. Dont just ask for status, say that you have called in the past and so far you know xxxx about your case. Some IOs are nice, some are rude. Nice ones actually tried to explain the entire storage area, holding area, supervisor supply chain to me. I think I kind of understand the process that happens at NSC just through these conversations now. Approach Ombudsman asap with form 7001. Call your Senator office and ask to speak to the immigration person. They are very understanding and will help you.

I have taken an infopass tomorrow to get the I-551 stamp on my passport. Once that is done I will be mailing out the form I-90 for replacement.
What is this I-551 stamp ? Is stamping that mandatory ? What kind of documents do you need while you go for this stamping ?
If one does not plan on travelling until we receive the physical Green Card - would we still have to do this stamping ?

A basic question - Are the months that the numbers are slotted into for the Priority Dates? or are they the recept date or something else....?
If PD, then how come there are numbers for 2008 and 2009? The PD has never been current since July 2007....

thank you for your info on calling uscis and requesting namecheck info.... i called them today, asked about FP 1 and if it had been sent out... they told me to wait for FP notice but they were able to check for name check info..... name check has passed..... 485 RD July 16 2007... thanks again for uscis contact info

When calling USCIS did anybody question, if they have not yet entered even July 2 filings, why do their weekly updates indicate otherwise. It is very pertinent question and a very valid point to be taken to a congressman.

This is the email I just received from CapitalOne:
"Sorry for the delay in responding. I've been out of the office unexpectedly and am now just getting a chance to catch up on past messages. Unfortunately we can't pursue candidates with EAD cards either."
There was a thread related to similar issues which I could not find. Apologies for opening a new one.
Doesn't the above constitute discrimination and illegal ? What recourse do we have when we are disqualified because of EAD ?
My neighbour just got a job at Capital One last week using her EAD . So I am not sure which policy this HR person is talking about. Capital One definately takes people on EAD and my neighbour is proof of it !!!

We have to pond this letter to every oneLike who is in Primary.
Thisis debatable issue, since it is about legal Immigrant.If we 500 thousand of us can do it , we have to pound the fax, then only it can be heard.

During the discussions on 1485 filing provisions we there were questions related to EB2, EB3 backlog numbers post 2007 july + Based on the recent information we got on pending numbers + our discussion on if EB2 will get current this year helps us understand how the last quarter will behave. This analysis is not official and is our own interpretation based on information we know. We do not wish to seek out specific information on visa bulletins. It has not been IV policy. VBkris has been involved with IV statistical analysis of data and has been in meetings with officials. He has come up with an explanation to this news and how it may play out for the last quarter.
