I am jumping ahead of the situation here, but I just wanted to see what other members think/know. Assuming that the 90K visa recapture happens, It doesnt take too long for them to be used up in the current situation where there are a lot of people with labors and approved 140's (w/PERM). Not every one will have an oppurtunity to file for a new labor and file for 485. If DOS makes the PD's current / post Mar 2005, wouldn't it be unfair to people who labors are pending for 3 yrs. How does this work out in the previous recapture? HLG doesnt say about numbers being forwarded to the next year though.
To be fair, maybe we should ask the lawmakers not to allow the recapture of the 90k visas to make sure that people with later PD will get GC later. Besides, we should ask DOL to retrogress again, maybe to sometime in 2000, to guarantee that everyone before that time gets his/her GC. We should also ask USCIS to stop processing 485s and resume until BEC finishs all the LCs.

I applied for my wife EAD renewal on May 3, 2010 at Dalls Lock Box Office, following is the message i got from USCIS today:
Your USCIS application/petition has been received and routed to the California Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number
WAC12345678901223. With the official Receipt Notice (Form I-797) you may visit USCIS Home Page (http://www.uscis.gov) where you can check the status of your application using My Case Status. We suggest you wait until you have received your Form I-797 before checking My Case Status.

I didnt. I dont know if there is any number to call to find the status.
I just called the number on the online status and the lady I spoke to initiated an inquiry and gave me an inquiry confirmation number. I dont know if that is of any good.

Even though its anticipated that EB3-I is screwed up for ever , I expected at least a snail movement instead its U for the whole of year. More of these days... I think we are all spending more time debating options.. We will go no where with waiting...
I think last year they did around 3000 odd applications for even at this rate it takes 30+ years and there is no relief in sight...
We have spent enough time already in thinking about ways... ONLY one way that works is some kind of legislative relief.. IV Core knows about it... These days every time i meet a friend or relative I have only one Message please join IV and contribute and if you dont want to contribute atleast please participate in any initiatives that IV Core might recommend.
I am in for the best i could do as we did in CIR 2007.

However in order to work on an issue, the push and support must come from members needing it. For that we will need support of Greencard holders who think that this an issue for them and they are willing to participate and support IV to go all the way. Right now we have our hands full with current IV agenda and need to accomplish those with our limited resources

If a birth certificate was recently issued, then it MUST BE SUBMITTED along with Affidavits of Birth, Executed by two immediate family members who were 5 years of age or older at the time the birth took place�(Please see attached sample)

I am in new job and mid of negotiating with blood sucker desi employer not to revoke i140. I can not attend the advocacy days.
Anyway like Eb3retro I also lost my interest so changed job. Profile don't meet much with what written in i140, so who cares if GC rejected I will be heading to India.

I understand your frustration since I am in the same boat but I feel it is wrong to say that the IV efforts are hurting EB3 folks. Not sure if there is basis to support that. Several IV proposals helped all EB categories and failed mainly due to anti-immigrant lobby.
EB3 situation is completely hopeless and only piecemeal reform can help EB3. I am sorry but I do not understand this discussion since this bill (if it ever comes to debate) impacts across all EB (advanced degrees).
Hear that you EB2 bigoted persons. Here is An EB3 person who is supporting IV inspite of what ever is happening. Will this open your eyes to the fact that EB3 folks are not against EB2 folks,but all that they want is that they should get some measure ofjustice.

I would now like to comment on some facts which are result of my observation over a period of 3 years starting from 2007 till current date
The only proposal which helped EB3 is July 2007 fiasco with EAD and AP benefit and before we give thanks to IV please remember that back peddeling by USCIS was not just because of just IV but also because of strong pressure from AILA. If EB3 benefited from July 2007 fiasco it is only because EB3 was part of all the EB categories and not because IV was aware of EB3 plight.
Now after July 2007 nothing has been ever done to relieve pressure on EB3. All the benefit have been provided to EB2 and all EB3 is told is after EB2 gets current EB3 wil get benefit but nobady talks about EB2 never getting current and the fact is EB2 will never get current and till that time EB2 will get all spill over visa and EB3 will get 0 (Zero) spil over visas

I am sure it was exciting news for us to hear. However, it appears the Immigration provision were removed before passing the bill. This is another proof that the IV core are right on track. It appears like they have good information and that immigration-related bills and changes will be passed in immigration bill itself and not attached to other bills. I think the congress will address the all the immigrant issues in a new CIR or some new immigration bill.

Since its a PD portability case, probably no PD is written on the receipt. It might be to be determined.
I'm not sure if you can file your 485 as well - dont see a reason why not. But one thing you can do to have better sleep at night :-), is to upgrade your 140 to Premium processing. If you get it done tomorrow, you will have an answer and portability of PD by end of this month. Then you know for sure where you stand.

I think all the backlogged labor applications are going to clear. But people like you may get very less time to apply maybe 15 days. My advice to you.
Start preparing to apply if you have not started already.
1. Do your medical exam. It is valid for 1 year.
2. Collect important documents. Birth certificate is most important.
Has to have .
a. In English
b. Need to indicate that has been prepared from original registration record.
c. Need to have your name,both parents names,
d. Registration date with date,month,year.
3. Fill up your forms.
Dont be dejected.This is the time for action.
Years we have been told priority date establishes your place in the queue.
We have spurned job offers and declined the new PERM process to hold on to the priority dates.
Many are still awaiting labor certifications from the backlog elimination centers. Out comes USCIS and says everyone with a LC can file I140 & I485.
People still waiting for LC with priority dates in 2003-2004 are seeing applicants who have priority dates as late as 2007 but with approved LCs through PERM walk through to I485.
Net result, USCIS is going to be flooded with applicants enough to retrogress the priority dates 3-4 years back as early as september. (Everybody with a LC will be able to file for I485 in July). So applicants with priority dates of 2007 are going to get EAD and GC, while LC backlogged 2003 applicants to have to wait for another 3-4 years before they can even file I485.

Very true - anyone who goes ahead in the queue is actually easing it up for the latter. This is Never about belittling a fellow sufferer.
If PhDs get a quota relief, will be good for all of us, although i personally will not qualify.
US Bachelors/Masters holders in a STEM field for example, will similarly ease up the system.
Hopefully all others will see it that way.

Hi folks, good to see great moment in IV with regards to advocacy efforts. I still remember the day I attended the rally in DC conducted by IV. I cant forget the crowd. Amazing.
Update on me - r2id in feb. Joined the new job. Enjoying every bit of it. Initial challenges as expected in settling down. But slowly things are moving. Got admission in school for kids, took an apt for rent etc. Just wanted to stop by and congratulate everyone in IV on the advocacy efforts.
GO IV..ians..This is the year we got the world cup. This could be the year where we get through to the lawmakers and make them understand the agony of so many families waiting in limbo in the GC queue. All the best.
Chaya, We are going back to India on personal choice. My manager here knows very clearly that I cannot take up promotions and the HR does not want to do eb3-->eb2 conversion. So, I took up this crap for a while, and decided to put an end to this misery once and for all. And fortunately the same company is offering me a job in India at a good designation with good compensation. Also, we were missing out (esp my kids) were missing out lot of things happening in India, which they want to be a part of. Original idea was to stay in US for 10 years and go, only difference is now, we did spend that 10 years but still dont have our GC. Another important thing that we considered was , it becomes more difficult to take this decision when we have GC in hand because, as much as it helps to stay in US, it avoids us from leaving US too, and to wait for citizenship is another 5 years from that point, which could all take easily 6 years to the minimum from today. Thats why we wanted to make it easy on us, and do this now.
Looking back, would I re-do this GC process one more time - no, but am I happy to be a part of IV - you bet I am. Thats the bottom line.

It was a memorable trip indeed! 3 weeks before, I thought Houston to DC was a long shot. I kept reading the IV forums and saw the energy built up. Then I decided, I should definitely do something from my part even if I don�t attend the Rally. I said to myself, enough, I am going to announce in the Texas thread that I am willing to volunteer for the publicity work in Houston during the long weekend. That�s when I got a chance to talk to Texanmom. We had a conversation for about 40 minutes and once I finishing talking to her over the phone my position changed from ��No way� to let me try to convince my friends and if I have company, I will go. I can always talk to my Boss later about taking a day off. Once I decided that, I kept calling all my friends in Houston. Sadly, I could not motivate people to buy tickets and fly with me to DC. My wife, then told me, if you want to go, you should go, don�t wait for your friends.
I am glad, I took that decision. The whole trip to DC was very memorable indeed. There were 3 of us in the same flight jayram123, Texanmom and myself. We had a volunteer (IV handle ?? � if you are reading this please tell me your IV Handle!), who picked us up and we all stayed in a hotel. Thanks for all your hospitality! We left very early and reached the location by 7:15 in the morning. It felt good to work with everyone and make the necessary preparation before the crowd started pouring in.
Early in the morning, GSC999 gave us a quick announcement session telling us what we need to do as volunteers and what was the plan. GSC999 - you energy was contagious. I was all ready and excited once I heard you talking about our plan for the day.
On of my best moment of the trip was handing out water bottles to all the participants who were standing besides the road showing their banners. This happened just before the actual Rally began. It was a nice feeling making all the folks comfortable and giving them water while they were all standing there for more than an hour flaunting their signs to the cars on the road. I was helping another volunteer in this effort and later found that he is from Houston too and is part of IV Core (please PM me your id if you are reading this). It felt so good that all of us were helping each other for our common cause.
I had one person ask me where can we find the nametag stickers which we give to the volunteers. I searched for a long time and then told that person that I will find it for him. Then I got busy with some other work. Only later I realized that it was not some other volunteer who had requested the nametags from me but it was Mr. Pappu himself! Pappu you are a very humble man!
A special thanks to the person who was pulling the cart with 2 packs of water bottles all along the Rally and distributing water to all the people who were walking in the Rallly. I tried moving that cart and found that it was TOO Heavy and decided to work on some other volunteering effort. But you did it. Thanks!
Also, the person who sang the National Anthem did a wonderful job! All the speeches were very nice too! The sound system arrangement was very professional. The Rally Marshals did a fabulous job and everything went exactly as planned. The arrangements made by the Cops with their cars motorbikes and bicycles was very impressive.
In all, it was great trip from Houston to DC. Thanks to jayram123 too who took care of all the travel logistics. I did not have a clue about the routes or the trains etc and was completely relying on him. Hoping to keep in touch with the Houston IV team and help with more efforts till all our goals are achieved.

Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision

On August 5, 2010, we mailed you a notice that we had registered this customer's new permanent resident status. Please follow any instructions on the notice. Your new permanent resident card should be mailed within 60 days following this registration or after you complete any ADIT processing referred to in the welcome notice, whichever is later. If you move before receiving your card, please call our customer service center at 1-800-375-5283.
During this step the formal decision (approved/denied) is written and the decision notice is mailed and/or emailed to the applicant/petitioner. You can use our current processing time to gauge when you can expect to receive a final decision
but no welcome email yet...
