    Flying through Asian Countires is not an option for people residing in East Coast. I am travelling to India in the next week Via Amsterdam. I am told by the consulate that we do not need Transit Visas. My H1B Visa is expired and I am travelling on AP. Did any one hear differently?

    Thats correct - they don't need transit visas - I did in mid-Dec, 2007 - absolutely no hassle. Also, I find Schipol one of the most pleasant airports in Europe (barring Munich).

    Also, does anyone remember where the I-485 was mailed? NSC or TSC? From what I remember it was based on what state you lived in when I-485 was filed.

    It was NSC for New York residents... Can someone confirm that please.

    Yes, it was based on the State you lived. One other thing, you may want to check with Customer Service, since when are you have been actually considered a PR. If they have considered you as a PR since 2008, it is good for you, you will be able to apply for Citizenship sooner

    I spoke all the the reps that someone posted not on this list.
    To add to the list of sponsors/co-sponsors, Congress Debbie Schultz is a co-sponsor for the bill (so don't call asking for support, but you can call to appreciate their efforts).
    I think it would be better to keep it brief. They don't have time, and we can't spend lot of time, or else we won't be able to call all of them. It took me 30 minutes to call all of them.

    I read somewhere that Steve King is not supportive, infact he's opposed to this bill. So it would be wise not to call his office. I don't he'll change his stance 'coz he's part of numbersusa/other nut cases.

    Also note the phone number of Robert Scott is wrong, it shows the phone number of Adam Schiff. I realized only after I called twice. but luckily I realised before I could go through the whole talking points.

    Pls everyone call before its too late. we need to get this passed as this is our only hope. PLS CALLLLLLL!!!

    Near the start of his Nov. 4, 2003, program on CNN, Lou Dobbs said, �One-third of the inmates now serving time in federal prisons come from some other country � one-third.� Later, he offered more details: �Coming up, we�re going to take a further look at the impact of illegal aliens. And it is an expensive proposition, particularly in our nation�s prisons. Illegal aliens, those citizens � noncitizens taking up a third of the cells in our federal penitentiaries.�

    He also said that illegal immigrants were �an increasing part of America�s prison population.�

    Here are the facts, according to the Department of Justice:

    In 2000, 27 percent of the inmates in federal prisons were noncitizens. Some of these noncitizens were illegal immigrants, and some were in this country legally. In 2001, this percentage dropped to 24 percent, and it continued dropping over the next four years, falling to 20 percent in 2005.

    Bottom line: illegal immigrants make up significantly less than a third of the federal prison population, and the share has been falling in recent years.

    �The share of state prison inmates who are noncitizens is much lower. (This is largely because immigration violations themselves are federal crimes.) In 2000, 4.6 percent of inmates in state prisons were noncitizens. This number remained quite steady over the next five years, right around 4.6 percent.

    �Over all � combining federal and state prisons � 6.4 percent of the nation�s prisoners were noncitizens in 2005. This is down from 6.8 percent in 2000.

    �By comparison, 6.9 percent of the total United States population were noncitizens in 2003, according to the Census Bureau.

    Anne Morrison Piehl, an economist at Rutgers, says there are a number of reasons that immigrants have a lower crime rate than the native-born population. (To read a paper by Ms. Piehl and Kristin Butcher on immigrants and crime, click here.)

    For one thing, the consequences of being arrested can be enormous for illegal immigrants, which is an obvious deterrent to crime. For another, immigrants, as a group, aren�t typical of the population. The fact that they have picked up and moved to another country suggests that they have more ambition, and perhaps even more skill, than the average person. This could help explain why the United States, a nation of immigrants, is such an economic powerhouse.

    Sent emails to USCIS Complaint deptt, Congressman and will be sending the fax to the director now.

    Hello every one,
    I am starting this thread for all of us not to just think about the GC process. If any one is residing here for 10 years without GC, think about making a law which can lead us to Citizenship. My thoughts on this:
    Many of our colleagues who landed with us during the late 90s (1998, 1999) and early 2000, who got their GC without any issues are now Citizens or waiting to become Citizen soon.
    What is our status?. Just think. Still we are strugling to get the GC. Even by law change, if we are getting the GC this year (by GOD's Grace), then we need to wait for another 5 years from now (approximately 2014). Many persons like me who have come to this Country in their later career will be very much affected due to this delay (we have lot of other issues like the dependents reaching the age of 21 etc., College, University fees etc.,).
    Core team and every one, please consider this and try to lobby for getting the citizenship without further wait if the persons satisfy the folowing conditions:
    1. If they are legally here for 10 years (With approved I-140 and waiting for Adjustment of Status without current date).
    2. If they have earned full 40 points in Social Security
    3. If they have paid the tax continuously for 10 years
    4. If they own a house and paying Mortgage (adding weightage to the Economy boost)
    and
    5. If they do not have any criminal records in these 10 years.

    Please again do not just concentrate on the GC issues. Consider this and if any one can come with a letter draft with legal openion, we can send it to all Congress members, State Governers etc.,
    Hope the members and the Core team consider this issue. I have one more thread on this, which I started some months back but the response was not that good. If every one of us unite on this and raise this to the Congress, I think the new Government may consider as this is very genuine.

    So thats just somebody's interpretation of letter campaign. Perhaps one of the enthusiasts over here should post something over there differentiating the goals of the letter campaign from illegal immigration along with all the arguments posted here and explain that their interpretation is incorrect.

    Why not take it upon yourself to help out?

    1. If a Receipt Number is issued for a I-485, does it necessarily mean that the case won't outright be rejected for a missing document/ evidence, but instead an RFE will be issued?
    2. When a receipt number is issued for a I-485, and if we send out the missing document/initial evidence using the allocated A#, is there a good likelihood that the evidence/document will make it to the appropriate file?

    Answers to these will help make a decision on filing multiple I-485's where the first I-485 missed some initial evidence.

    One more thing: I was about to make another private consultation call today. I pledge contributing $200 if I find a concrete answer to this issue without having to consult one more lawyer.

    My laywer ( a known one, but not the regulars here) also didn't include EVL. When i asked him about it, he said whether we include it now or not, they will issue an RFE at the time of adjudication. I was content with that, but after reading about it more here, i pressed him again about the issue and the new memo. He said he does not foresee a denial because of this, but if i'm worried we will send the EVL along with a cover letter and the RN. But filing another 485 is not advisable. I'm working on the EVL, and once he is less busy after Aug 17th i will ask him to send it. And i hope it will make it to the right file if we include the RN and A#, just like replying to an RFE.

    btw, to answer #1, i did get RN so i would think the case may not be outright rejected for missing evidence. I did FP and my LUD was changed for 485 and 131. I filed 765 later and that also has an LUD after FP.

    No one can travel on EAD. EAD is for employment authorization. AP is for travel. You cant mix and match the purpose of them.

    If you dont need to travel or if you have a valid H1 stamp for travel, dont file for AP. If you want to travel and if your stamp has expired and dont want to apply for new stamp, then file for AP.

    If you want to work for your employer and continue there and if you are sure of your job security, then you dont need EAD, and dont apply for EAD. However its a good idea since EAD is a great option of you are suddenly fired or laid off. EAD makes it easy to search for jobs coz the employer doesnt have to file your H1 and you can join them immediately without any hassles.

    You are correct. When I filed on 2005 I did not apply for either AP or EAD. My H1 was valid until May 2007 and I do not intend to change jobs or travel(my country is too dangerous :mad: ).
    I am already 55 :rolleyes: and am not going anywhere.
    In January 2007 I filed EAD myself and got it approved in 40 days. My lawyer was charging me $400 to file it.

    I called the department of state, visa's section to enquire about this PIMS verification. They said that KCC handles it. When I called KCC they said they cannot check ahead of time :mad:


    Folks who had delays in getting H1b stamped due to the PIMS system:

    Can you look at your I-797 and see if there was an A number (something like A123 456 789) mentioned under the "Beneficiary" box?

    I am applying for AOS on a EB basis. My wife will apply along with me as a beneficiary. Unfortunately she worked on H1B for another company without notifying USCIS and on a different job capacity. What are the chances for her I485 to be denied? Do we have to mention that in I485 form. She is currently on H4 and is not working. Thanks.

    When her employer applied for H1B means that he notified USCIS & got approved! She will be fine & she will get her GC along with you. No worries.

    Emirates is good. No TV hassels. JFK to HYD trip is good because it starts at 11pm but on the way back it was little painful because you start your journey at 4 am in the morning and if you are a person like me who can't sleep at irregular hours, then it can become painful sitting for long time in the flight.



    We are planning to make a trip to Hyderabad, India along with my wife and my little baby boy. After reading all of your experiences, I am not sure which one should I opt for. We have an expired Visa on passport, planning to Use AP. As we are travelling first time with the little baby boy, I am looking for some hassle free flying. I stay pretty closer to Harrisburg, PA ...thanks

    May be it was updated on the website on 25th Aug 09, System date should be present on the report, Report with out date on it is meaning less, I hope the USCIS IT team will understand that, I dont understand what kind of reporting specialists USCIS hires, that is a fundamental thing USCIS should know, Report should have a system time stamp on it saying when it was generated.
