Have you tried to reach the CIS via infopass? 'Aging out of children' is one of the extraordinary situations which can force the hands of CIS. It is on the USCIS guidelines. In your case, you can ALSO go to your congress members to look into this. Extraordinary situations require extraordinary responses. Good luck.

Before we ask Congresswoman Zoe Lofgren for any further help/support, don't you guys think it will be appropriate to first thank her in some kind of noble way? Any ideas?
I personally think (at least to begin with) a letter expressing gratitude for and our faith in her efforts would be a nice gesture.:)
Do we know for sure that this letter is in fact real? I mean yes it's on one website that has a link to a PDF document, but surely we can get it verified from another source (and I don't mean another immigration website forum) before we start sending her thanks and flowers.

I can imagine what was going through Slumdog's mind. But believe me, I was in similar situations twice in 2001 and 2003, well, not exactly, I should say, our entire department of 89 were wipped off keeping just our big boss on board. 100 guys came from India and looked over our shoulders for couple of weeks, we were asked to train counterparts and ensure the success on everything that we used to do on a daily basis. At the end of the month all of us were out of work. Jobs were shifted to outsourcing company in india.
I was feeling terrible for couple of days but found a job after 2 weeks and the history repeated again after 14 months. Similar situation but different faces. This time the pain was not as bad as it was during the first time. Ofcourse, I had to move to west coast leaving my cherished home and live in a rented apratment..
But my friends, looking back at the events, I can see that those situations solidified my convictions and made me much stronger. I truely believe, well, I know now that what ever happened in the past was for my good.
If you really think, all our worries are either the things that has happened in the past or anxiety about future. Past is gone and future is unknown. Do not think too much about future or past... we all want to be happy and happiness is available only in the present moment as some one said. We miss very easily as constantly present is turning into past.
Its one thing to know what is going on around us and other to be fearful and feeling defeated... we have to walk that thin line.

Totoro: I really liked the way you alone initiated and handled the fight against Stimulate Package - ITIN issue. You can be a true leader and helpful in many way to this/any community. People like you can make difference in people's lives.
There are so many issues we are facing as a community. Let's pick top 3 ( OR 5 )for you to discuss with them. If there is any room, you can discuss least imp. issues as well.
Issue NO 1: Retrogression / Backlog for EB3/EB2
How to solve it ?
- Visa Recapture
- Saving visa by not issuing visas to applicant who are not current as per "Processing Times' Currently, CIS is approving many I-485s with PDs having currant but are not currant as per ' Processing Times'. 'Processing Times' needs to be respected. This will save huge number of visa for retrogressed countries.
- Buying Visa for dependants and not counting towards annual cap. ( Easy way to reduce backlog - more than 50% visa would be saved. Will solve problem in 1-2 years. No other action required.)
- Removing per country limit.( Requires changes in law - tough task/long shot.)
- Buy a house and get a GC idea ( its been widely discussed in media ...)
- Any more suggestion ?

Let's help these guys who can't file I-485/EAD as their PDs are not current. These are the people who are likely to suffer most in case of a job loss/visa issue. Even, their LCA/ I-140s are approved, it will become useless if they get fired/companies run some in problems etc. which can happen to any one in current times. Personally, I say - this should be our priority - can be fixed easily. It would also attract them to join us. A dying soldier saves other first.

Issue No - 5 Allowing work-permit for H4/dependants ( Not that important but will change lives for many)

It was good to hear that they are now very aware of these bills.
Nearly all used the ploy "Where are you from?", to screen out those who are not from their district, but politely noted the call in their logs.
It was also good to be able to say that I had already spoken with my Congressman on the subject (because that's where they expect you to go first).
I've spoken with a lot of law maker's aids, and this ("where are you from?") is a ploy that is typically used when they have a high volume of calls. I would take that as a good sign.

Same here, I have Masters from a very high rated US University and 10 years of experience, but was misguided by attorneys, as there was no retrogression when I applied. Ending up with EB3.
Members like I_Got_Skillz are new kids on the block, who think that only they got masters in the whole world. Just from their sign-in names you can tell how immature they are.
I think big changes like CIR, elimination of EB2 or legislative amendments are not feasible right now, and we should try for some low profile but effective changes that can be done by decision makers at USCIS itself, unnoticed by politicians. For example, somehow convincing USCIS to change their spillover rules, so that EB3-I can get some benefits. We can try to make them understand that doing this will eliminate a lot of their old time backlog and will increase their reputation among other federal departments.
ChrisRock, Raju & other EB3 members must realize as long as members like I_Got_Skillz are here who are lurking just to ruin any EB3 conversation, it is very difficult to come up with a solution.
Also, the idea that an EB2 is more skilled and EB3 is not, is wrong since EB2s are nothing but the same qualification with a few more years of experience and EB3s are the same but who have been misguided by the attorneys when retrogression was never there.
Example, in my case, I have a masters, 7 years of experience before starting my green card app. Currently, I have a total of 15 years of experience as of today working in various domains.
In my opinion if you are looking for a solution which is more radical but practical, it should be in a way where there is a highly skilled category which should be more like EB1 and the rest. I think EB2 should be eliminated and merge both EB3 & EB2 candidates and do a FIFO processing. Isn't this the way most of the countries in rest of the world gave their process?
These are all changes which cannot be done due to politics, but in my opinion is the right approach.
Even some of the IV state chapter leaders etc are people with EB2 apps and they shoot down anything which works to their disadvantages.
It is only the IV Core & a few other members which really care about the backlog irrespective of category.
Please note, I am not naming any state chapter leaders in particular, but I have observed via threads & posts how their line of thoughts are.

Congrats to all those who have received their approvals. Do you get a "Card Production Ordered" email or "Welcome" email or both?
My attorney got an e-mail, i haven't gotten an e-mail yet. But i checked my online case status, which says card production ordered, should have card in 30 days time. My atty said that they are having some trouble right now with card production, so maybe that is why it says 30 days instead of 10 business days as it did in the past.

I sent my passport for renewal on Nov 9th, 2007 to Houston.
I have to visit India in Jan. I went by the time lines listed on the website and hope they it back to me within 2-3 weeks.
I requested in a detailed letter to them if I should bump the application up to an emergency. Hope to get a response back.
( I know I might be hoping for too much here. I should have applied well in advance. )

Unfortunately your friend is correct - the alternate I can think is withdraw your present application and file I-140 and I-485 simultaneously now - other please tell whether this will be a good approach for their benefit. Can EB3 file concurrently I 140 and I 485.
On my wife's labor certificate, it is said her position requires a minimum of master degree. But the alternate is bachelor degree plus 2 years' experience. The lawyer has filed I-140 under EB2.
We are worried that this position does not qualify EB2 because we read on the internet that EB2 requires master degree or bachelor plus at least 5 years' progressive experience. We called the lawyer and said we heard from a friend such a case had been denied. She was very busy and just said there was no problem to apply for Eb2, and if we doubt it, we can hire our friend as a lawyer. We are so pissed off.
Can someone help me clarify if this position is qualified for EB2? do we need to change it to Eb3?
