Visa Bulletin Mess Update: Rumors and Innuendo
HLG has confirmed that the CIS is not returning I-485 Applications back to those who filed I-485 during the first week of July. This is leading many to speculate that the CIS may reverse course and re-re-amend the July Visa Bulletin; whether the Visa Bulletin actually reopens remains to be seen. HLG normally refrains from commenting on rumors, but we have talked to several Washington insiders and believe that this is seriously being considered.
What does this mean for foreign nationals who planned on filing I-485s in July 2007?
HLG recommends that all foreign nationals who planned on filing I-485s in June take two actions:
Have your medical appointments completed. Medical appointments can back up quite quickly. Therefore we urge people to complete their medicals.
Send in your documents to HLG. HLG�s I-485 Step By Step Guide has a list of documents that we need for all I-485 filing. HLG will not begin preparing the I-485 at this time, but we still recommend that you send us all of the items on the list.

one another suggestion I have to make is this:
We need to get Indian/Chinese community (citizens) involved to fight for us.
We need to have some of them as leaders in the IV. (they could be people who have struggled with the EB process and identify with us) they could be highly successful Indian/chinese or other countries businessmen/scientists/media personal etc etc (if possible)
Remember the strength of the ilegal community is that their legal brothers and sisters dont hate them but always stand with them.
We somehow ( I have no clue how) need to get this to happen. Also each one of us who are currently here should make a pledge that "Even if my card is printed, I will continue to use the extra freedom that I got to always stand up and fight for my brothers and sisters who are struggling with this system".

USCIS website allows only attorney or employer to track PERM cases online. There is a way if your attorney or employer make sub-account and give you access to track your PERM application. Trust your employer and ask them to track your case for you. They did same thing for me because they created employer account for themself to track several peoples PERM Cases.

On June 14th the Visa Bulletin was published for the month of July, and all EB1, EB2 and EB3 green card cases are current starting July 1st, except "other workers". We have learned that this was done to ensure that no employment based green card numbers will be unused for the 2007 fiscal year, which ends on September 30, 2007. As we reported in a prior Immigration Update, an employment based green card cannot be approved without a current priority date. Additionally, the third and final stage of the green card process, Adjustment of Status or Consular Processing, cannot be filed, unless the priority date is current. US Citizenship and Immigration Services will be flooded with I-485 Adjustment of Status applications on July 2nd, the soonest the cases can be filed. Processing times for the Adjustment's interim work and travel authorization are expected to increase beyond their current 90 day times. USCIS has confirmed that Adjustment filings must have all of the requirements (medical clearances, birth certificates, etc.), or the application will be rejected. The priority dates could retrogress to their current levels, or further back, as soon as August 1st, but definitely by October 1st, once enough green cards have been issued for the 2007 fiscal year. Unfortunately, with the end of the comprehensive immigration reform bill, mentioned above, we are not likely to see an increase in the number of employment based green cards anytime soon. Once an Adjustment of Status is filed, an applicant can continue to secure work and travel authorization extensions, until the Adjustment can be decided.

Wastage of H1 visas is criminal.There should be a quota on H1 visas per company-no more than 500-1000 per company,plus percentage limits of h-1 visas to total employees in a company.Along with this if there is a simple provision as there is in other countries like england,where the spouse can work too it will solve a lot of issues.
The self regulating nature of the market is the fundamental basis of this capitalist economy. There should ideally be no quota's for anything. The market will decide the ideal number of H1Bs. In 2007 when there are a lot of jobs, then a quota of 165K would also get filled up. In 2002/2003 when the quota was 165K, there were unused H1B visas. If you have a limit of 500 and a company already has 500 H1Bs and wants to come out with a new product and cant find non-H1 engineers, what should they do? Outsource? lay off some other H1s to stay within the quota?
If you do want to have a quota, then as someone said, H1Bs should be given out on some sort of points system based on experience+education+salary, instead of the lottery. Let the more 'valuable' candidate into the country.

My child aged out on Aug 25th last year. MY labor was filed in 2001 and took 6 years to clear. My I-140 was approved in March 2007.
